1. SCOPE OF WORK: Tke woxk covered by these plans and specificatzons consist a£replacemeat of
existing reinforced coacrete pavement with a min;mtun of 7" reinfoxced pavement sec�ion and ihe
replacement of failed joint matezial with silicone sealanis, construction of curb as needed.
2. AWARD OF CONTRACT: Contract may not necessar�y be awarded to the lowest �idder. The City
Eagineer shall evaluate and recommend to the City Cauncil the best bzd which is considerad to b� in
the best �aterest of th� City. Contract will be awarded to the lowest xesponsive �idder.
3. WORKIlVG DAYB: The Contxactor agrees to completa the Contract within the alIot�d �nutnber nf

6. CONTRAGT DOCiJMENTS: Bidders shall not separate, detach or remove any portion, segment or
sheets from the con.tract documents at any time. Failure to bid or fully exe�ute contract without
retaining contraci documents intact may he grounds foz desigx�ating bids as "nonresponsive" and
rejecting bids or voiding contract as appropriate and as detertnined by the Assistant Director of the
Depart�xieni of Transportat�on Public Wozks. '

7. MAINTENANCE STATEMENT: T�e Cont�actor shall be respansible for defects in this pzoject due ta
faulty xr�terials and warlrnnans�ip, ar both, for a period of one {Lj �ear from date of final acceptance of
this project by the City Council of the City of Fort tiVorth and will be required to replace at bas expense
any part ot all of the project which becames defective due to these carrses.
TRAFFIC CONTROL: Thc contractor will be required to obtain a"Street Use PernuY' prior to stariing
to work. As part of the "Street Use Permit" a traffic control plan is requi.red. ThE Contra.cfor shall be
responsible for providing tra#�"ic controi during the construction of tlus project consistent with the
provisions set forth in the "Latest Edition Texas Manual on Uni%rm Traffie Conixql Devices for
Streets and Highways" issued undar the authonity of the "State of Texas Uxufo�rm Act Regulating
Traf�ic on Highwaqs", codiiied as Artiole 6701d Vernon's Civil Statues, pertinent sections being
Section Nas. 27, 29, 30 a�ad 31.
This traf�ic control plan shall be submitted for review to Mr. Charles R. Burkei� Cifiy Traffic Engineer
@ 817-871-6594 at laast 10 working days prior to the pre-cons�uction conference. Although wark
will not begin until the traf�'ic con�rol panel has been reviewed the Contractor's time will begin in
accordance �wieh the tirne frame established in the Notice to fhe Contractor.
Th� Conlzactor will not remot�e any regulatory sign, instructional sign, stree� name sign or other sign
wluch has been erected by ti�e Czty. if zt is detexnanned that a sign musi be rernoved to petmit required
construction, the Contracto�r sha$ contact the Txansportation and Pn61ic Works Departrnent. Signs and
Ma�kings Division {phone number $'71-2531 or 871-773$}, to remove the sign. In the case af
regulatory signs, fi11e Contzacto� must replace ttxe pernaanent sign with a#emporary sign meeting the
requirernents of the above referenced manaal and such ternporary sign must be installed prior tn the
remo�al of the permanent sign, If the temporazy sign is not installed correctly or if it does not meet the
required specifications, the permanent sign shall be left in piace until the temporary sign requirernents
aze naet. When construction work is completed to the extent that the p�IIna�zent sign cau be zeinstaIled
the Contractar shall again contact the Signs and Markings Division to reinstall the permanent sign and
shall leave his temporary sign in place until such reinstallation is completed.
9. PAYMENT: The Contractor will receive $T-weekly payment (minus 5°/Q retainage) from the City foK
a!1 work generat�d withiu a pay period. Payznent of the remaini� amount shall be made with final
�aayment and upon acceptance of the projeet.
10. DELAYS: The Contractor sha�l receive no campensation faz delays or hindrauces to the wozk, except
when direct and unavoidable extra cost ta the Contractor is caused by the failure of Yhe City to provide
information or matexial, if ar�y, wbich is to be fumished by the City. When such extra compensation is
cIaimed a t�vritken staternent thereof shall be presenfed by #lie Contractor ta the Engineer and i£by him
found correct shall be a�provad and raferred by him to the Council for final appraval or disapproval;
and the action thereon by the Council shall be final and binding. TF delay is caused 6y speciiic orders
given by the Bnginaers to stop work or by the perforn�ance of extra work or by the failure of the City to
provide material or necessary insiruc�ions for carrying on the vvork, then such delay will entitle the
Cantractor to an equivalen# exkension of time, his applicatian foz wlv.ch shall, hawever, he sabject to
ihe appro�ai of the City Council; and no such extension of time shall release the Con�ractor or the
surety on his perforcnance bond form all his obligations hereunder which shall rexnaiun in fitll force until
the discharge of the contraet.
11. DETOURS AND BARRICADES: The Con�actar shaII prosecufe his worlc in suc� a manner as to
create a mi�imum of interruption to traffic and pedestrian facilities and ta tt�e flow of velucular and
pedestrian tr�ffic within the project area. Co�tractor shall proiect construction as required by Engineer
by providing barricades.

�2. D�SPOSAL QF SPOJL/FI.LL MATERiAL: Prior to the disposing of any spoiUfill inaterial, the
contractor sha11 advise the D�rec#or of the Department of Engineering acting as the City of �ort Warth's
Fload �lain Adnai.nistrataz ("Administrato�r"), of the locaiian of all sites where tlze contractor intends to
dispose of sucl� material. Contractor sha11 nat dispose of such �aterial until the propased sites have
been deternvned by the Administrator to meet the requirements of the Flood Plain Ordinance of the
City of Fort Worth (Ordinance No. 10056}. AIl disposal sites must be appro�ed by the Administratoz
to ensure the filling is not occurring within a flood plarn without a penxut. A flood plain pernut can be
iss�ed upon appraval of necessary engineezing studies. No fiIl perinit is rec�uired if disposal sites are
not in a£�ood plain. Approval af the contractors disposal sites shall be evidcnced by a let#er signed by
the Administrator stating that the site is not sn a lmown flood plaizx or by a Flood Plain fill Permit
anthorizing fil� within the flood piaim. Any expetises assaciated wiih obtaining the �ll permit, ihclnding
a�y necessary engineering studies, shall be at the contractors expense. In the event that the contractor
disposes of spoilliill materials at � site v�ithout a fill pernnit or a letter from i�e administrator approving
the disposal sife, upon nolification by the Director af Engineering, contractor shall remove the spoillfill
material at its expense and dispose of such materials in accordanee with ihe Ordinance of the City and
t�s section. No temporary storage of material, rubble, equiprnent or vehicles within Parlcway is
allowed. Dama.ge to sodded/landscaped areas would be replaced ai Contractor's expense to the
satisfaction of City Eng�ineer.
13. CONSTRUGTION SCHEDiTLE: It sball be the responsybility of the Coniractor to fuirnish the
Construction Engineer prior to construction a schedule autliniz�g anticipated time each phase of
construction will begin and be compLeted, including clean up time.
14. zONII�iG REOUIREIvIENTS: Durin� the construction of this praject, the Coniractor sha11 cQnn.ply with
present zoning requirements of the City of �art Worth in the use of vacant property fox storage
parposes.
15. OUALITY CONTROL TESTING:
(a} Tf►e contractar shall fi�nish, at its own elcpense, certifications by a private laboratory far all
materials proposed to be used on the praject, ineluding a mix design for any asphaltic and/or
Portland ceraent concrete to be used and gradation analysis for sand and crushed stone tQ be used
along vvith the narne of the pit from which the znaterial was taken. The contractor shall provide
manufact�uer's ceztif'xcatioas for all manufactured itesns to be used in th� pzoject and wrill bear any
expense related thereto.
(b} Tests of the design concrete m� shall be made t�y the cont�actar's laboratory at least nine days
priar to the placing of concrete using the same aggregate, cement and mortar which are to be used
later in �he concrete. The contrac#or sYiall provide a certifiad copy of the test resuIts to the City.
(c) Quality contral testing oi in situ materiaL on this project wili be perfomzed by t�e City at its own
expense. Any retesting required as a result of failure of the material to meet project specificatious
wiIl be at the e�ense of the contractor and will he hilled at commercial rates as dekenmined by the
City. Tlie fa�lure of tl�::e City to make any tests af snaterials shail in no way relieve the contracYor of
its responsibili#.y to fi�riush materials and equip�nt can.fonming io the requirements of the
contract.
(d} Nat less than 24 hours noU.ce shaIl.be provided to the Cify by the contractar far operations
requiring tesiing. The coniractor shall provide acceas and trench safety system (ifxequired) for tlie
site to be tested and any wozk effort involved is deemed to be included in the unit price for #he
item being tested.

job site. The ticket s}�ail specify the name of the pit supplying fhe fill material.
16. PROPERTY ACCESS: Acc�ss to adjacent property shall be maintained at all Yimes unless oth,erwise
��rec�ed by the Engineer.
17. SAk'ETY RESTRICTIONS - W�ItK NEAR HIGH VOLTAGE L[NES:
'Phe following procedures will be followed regarding the subject item on t1�is contract:
(a} A w�arning sign not less than fi�e inches by seven inches, pain�ed yellow with blacic letiers tha.t are
� Iagibie at twelve feet shall be placed ivaside and outside vehicles such as cranes, derricks, pawer
shovels, drilling rigs, pile drivers, hoisting equipment or similar apparatus. The wazning sign shall
read as follows:
"WAI�iVING—UNLAWFi7L TO OPERATE THIS EQUIPMENT WITHIN SJX FEET OF HIGH
VOLTAGB LINES."
(U) Equipment fhat may be operated within ten feef of high voltage lines sh�ll have an insulating cage-
i�pe of gnard about �he boorn or arm, except back hoes or dippers and insulator lini�s on the Lift
haod corinections.
{c) When necessary to work within six feet of high �voltage electric lines, nati�icatian shall be given the
power company (TU Electric Service Campax�y) which will erect temporary rnechanical barriers,
de-energize the liine or raise or Iower the line. The work done by the powa� compaxAy shall noi be
at �e expense of the City of For# WQrth. The notifying depariment sha11 maintain an accurate Iog
of all such calls to TU E�ec�tic Sezvice Company and shall record ac�ion taken in each case.
(d) The cr�ntractar is required to make arrangem�ents with the TU Electric Ser�+ice Company for the
temporary reloeation ar raising of high voltage lines at the contractor's sale cost and expense.
(e} No person shall wazk within six feet af a high voltage line without protectian having been taken as
outiined in Paragraph (c).
18. RIGHT TO AUDIT:
(a} Contracior agrees fha# the City shall, until the expi�ation of tluee (3} years after fina! payment
under this contract have access to and the right to exauune and photocopy any directly perti�ent
books, documents, papers and records of the enntractor invol`+ing transactions reiating to this
contract. Contractor agrees that tha City sha�l have access during normal working haurs ta aII
necessaz� coat�ractor facilities and shall be provided adeqvaYe and appropriate work space in oxder
to conduct audits in cornpliance wifi1� the pzovisioz�s of tlus section. The City shall give contractor
zeasonable afl�ance notice of intended audits.
(b) Coniractor further agrees to include in all its subcontracts hereunder a provision to the effect that
the su�contractdr agrees that.the City shall, under the expiration of three (3) years af�er �'iinal
payznent under the subcontract, have access to and the righf to examuie and photocopy any directly
pertinent boaks, documents, gapers and zecozds of such su�contracior invol�+ing transactians to the
s�bcontraet and further, that City shall have access during nomial working houxs to all
subcontractar facilities and shall be prnvided adequate and appzopriate work space in arder to
conduct audits in compliance wirh the pzovisions of tlus article togetlzer with subsect�on (c )
hereof City shali give. subcontractor reasonable advance narice of intended aadits.

2. MAT�RIALS
3.1 The silicone joint sealant shall meet Federal Speciizcation TT-5=441543A for
Glass A sealant except as modified by the test requirements of this specifica#ion.
Before the snstalIation of the joint sealant, the Contractor shall furnish the
Engineer certification by au independent testing laboratory that the silicone joint
sealant meet these requirements.
3.2 The rnanufacturer of the silicone joint seaIant shall have a minirnum two-year
demonstrated, docutnented successful �ield performance with Fortland Cemant
Concrete pavement silicane joint sealant systems. Vezi�iable docutnentation shall
be submitted to the Eng'sneer. Acetic acid cure sealants shali not he accepted.
T'he silicone sealant shall be cold applied.
3.3 Self I,eveling Silicane Jaint Sealant
The joint sealant shall be Dow Corning 89Q-SL self-leveling siticone joint sealant

The back rod and breaker tape shall be installed in the saw-cut joint to prevent
the joint seala�at from flowing to the bottom of the joint. The backer rod and
breaker tape sball be compatihle with the silicone j Qint sealant and no bond or

3. 'TIlVIE OF APPLICATION
On newly constructed Portland Cement Concrete pavernent, the joinYs shaIl be
initially saw cut to ihe required depth with the pcoper joint spaoing as showa on
the "Construction Detai�" s�eet or as directed by the Engi�eer within 12 hours of
�he pa�ernent placement. (Note that for the "dummy" j aints, the nutial 114 inch
width "g�reen" saw-cut and the `Yeservoir" saw cut are idenfacai and should be
part oithe same saw catting aperation. Immediately after the saw cuttiag
pxessure wasiiing shalI be applied to flush the concrete alurry frorn the freshly
saw cut joints.) The pavement sha11 be atIowed to cure faz a cniniinum af seven
(7) days. Then the saw cuts far the joint sealant reservoir shall be made, the
joint cleaned, and the joiiat seala�nt installed. During th� appIica�ion oith� joint
sealant, the wea�er shall not be inclement and the temperature shall be 40F (�G)
and rising.
4. EQUIPMENT
5.1 .All necessary equipment sha11 be furnished by the Contractor. The Contractor
shaIl keep his equipzn�nt in a satisfactory working candition and sha�l be
inspected by the Et�gineer prior to the beginning of the work. The miniinum
requirements for consiruciion equipment shall be as %llovvs:

6.4 7oint Sealant: Upan placernent of the boad bzeaker rod and tape, the joint
sealant shall be applied using the mechanical injectian taal. The joint sealant
applicatioz� shall not he pertnitted whea the air and pavement tempezature is less
than 40F (4C}. Joints shall not be sealed unless they are clean and dry.
Unsatisfactorily sealed jaints siiall be refilled. Excess sealan# lefi on the
pavement surface shall be rennoved and discarded and shall not be used to seal
the joints.
The pavemeat surface shal� present a clean final condi�ion.
Traf�ic sha11 not be allowed on the fresh sealant until it becomes tack free.
Approval of Joints: A representative of the sealant manufacturer shall be present
at the job siie at the beginning tif the fmal cleaning and sealing of the joints. He
shall demonsfrate tn the Contzactor and the Engineer ihe accc�atable method for
sealaz�.t insta�latian. The manufacturer's representative shail approve the cl�an,
dry joints befoze the sealing operation commences.
6_ WAI2RANTY
The Cantractor sha11 provide the Engineer a maanfactEuer's written guarantee on all
}oint sealing materials. The manufacturet shall agree ta provide any replacement
material free of charg� to the City. Also, the Cantractor sha11 provide the Engivaeer �
writien warranty on all sealed joints. Tt►e Conixactor shall agree to replace any failed
jaints at �o cost to the City. Both warranties shall be for one year after finai
acceptance of the completed wark hy the Engineer.

tools, appliances and materials necessary for the constructian and completiort of said praject in accordance
with all the Plans, Specifica�ions and Contract Documents prepar�d by the Transpartation and Pu�[ic Works
Department of the City of Fort Worth adopted by the City Council of fh� City af F�r# Worth, which Plans,
Specifica#ions and Contract Documents are hereto attached and made a�art of this contract the same as if
written herein.

The Cantractar hereby agrees and binds himself to commence the construction of said work
within ten (10) days after being notified in writir�g to do so by #he Transpartation and Pui�lic Warks
Department of the City of Fort Worth.

The Contractor k�ereby agre�s to pros�cute said wor�c uvith reasanable diligence after the
commencement ther�of and to fully complete and finish the same ready for the inspectian and approval of
the Transportation and Public Works Department of the City of Fort Wor�h and #he City Council af the City
of Fort Wor�h within a period of 100 workinq days.
If the Contractor should fail fio camplete the work as set forth in the Plans, Specifications anc�
Cantract Documer�ts within the tim� so stipulated, plus any additional time allowed as �ra�ided in the
Generai Conditions, there shall be daducted from any monies due or which may thereafter become due
him, t�e sum af $315.Q0 per working day, not as a penalty but as liquidated damages, the Cantractar and
his Surety shall be liable to the Owner for sucn deficiency.

Should the Cantractor fail to begin the work herein pra�ided far within the time i�erein fixed or to
carry an and complete the same according ta the true meaning of the intent and terms of said P1ans,
Specifications and Contract Documents, then the Owner shall have the right to either demand the surety to
take over the work and complete the same in accordance with the Contract Documents or to take charge �f
and complete the waric in such a manner as it may deem proper, and if, in the completion thereof, the cast to
the said City shalf exceed the cantract price or prices set farth in the said Plans and Specifications made a
park hereaf, the Contracto� andlar its Surety shall pay said City on demand in writing, setting forth and
specifying an itemized statement of the tatal cast thereof, said excess cost.

C�ntractor covenants and agr�es to indemnify City's engineer and architect, and their
personnel at the project site for Contractor's sole negligence. In addition, Contractor cov�nants and agrees
to indemnify, hnld harmless and defend, at its own expense, the Owner, its officers, servants and
employees, from and against any and all claims ar suits for proper�y Eass, property damage, personal injury,
including death, arising out of, or alleged to arise out of, the work and services to be performed hereunder
by Contractor, its officers, agenfs, empfayees, subcantractors, licensees or invitees, whether or naf anv
such iniurv. damape or deafh rs cau�ed in whole or in part bv ihe ne_qliaence or alleqed neaficrence
of Owner, rfs offrcers, servanfs, or emalovee�. Contractor likewise covenants and agrees to indemnify
and hold harmEess the Owner fram and against any and all injuries to Owner's officers, ser�ants and
employeas and any damage, loss or destructian to property of the �wner arising from the performance of
ar�y of the terms and con�itions of this Caniract, wheiher or not any such iniury or damaare rs caused in
whole or in pari bv fhe neqlipence or alleqed neqliaence of Owner, iis offic�rs. servants or
empfovees..
In ti�e event Owner receives a written claim for damages against the Cantractar or its subcontractors prior
to final payment, final payment shall not be made until Contractor either (a) submits to Owner satisfactvry
evidence that t�e claim has �een settled andlor a release from the claimant involved, or (b} provides Owner
with a[etter from Contractor's liability insurance carriar that the claim has been referred to the insurance
carrier.
The Director may, if he deems it apprapriate, refuse ta accepi bids on other City of Fort Warth public wor[c
from a Cor�tractor against whom a claim for damages is outstanding as a result af work }��rformed under a
City Contract.

The Cantractar agrees, on the execution af this Contract, and before beginr�ing work, to make, execute and
deliver to said City of Fort Worth good and sufficient surety bonds for the faithful perFormance af the terms

and stipulations of the Contract and for the paymenti to all ciaimants for labor andlar materials furnished in
the prosecufian of ti�e work, such bor�ds being as provided and required in Articfe 5160 af the Revised Civil
Statufes of Texas, as amended, in the form ir�cluded in the Contract Documents, and such bonds shall be
One Hundred P�rcent {'f 00%} of the total cortfract price, and the said surety shall be a surety company duly
and legally authorized to da business in the State of Texas, and acceptable to the City Council of the City of
Fot# Wflrth.

Said City agrees and binds itseif to pay, and the said agrees to recei�e, for all of the aforesaid work, and for all
additions thereto or ded�cfions ther�from, th� price show� on the Praposal submitted by the successful bidder
hereto attached and made a part hereof. Pa�+ment will be made in monthly installments upan actual work
completed by Contractor and accepted by the Owner and receipt of indoice fram the Contractor. The agr�ed

It is further agreed that tha performance of this Cflntract, either in whole or in part, shall not
be sublet or assigned fio anyone else by said Contractar withouf the written consent af the Director of the

The Contract�r agrees to pay ai least the minimum wage per hour for all labor as the same is
classifiecf, promulgated and set aut by the Gity af Fort Worth, Texas, a copy of wf�ich is attached hereto and
made a part hereof the same as if it vvere copies verbatim herein.

It is mutually agr�ed and understood that this agreement is made and �nter�d inta by the
parties hereto wiih references to the existing Charter and Ordinances of the City of Fnrt Worth and the laws
of the State of Texas with refierences to and governing ail matters affecting ihis Contract, and the
Contractor agrees to fully comply with all the provisions of the same.
