HomeMy WebLinkAboutIR 7931 INFORMAL REPORT TO CITY COUNCIL MEMBERS No. 7931 0,�R7Eq� (0'iem To the Mayor and Members of the City Council June 20, 1995 1873 Subject: PUBLIC NOTICE REQUIREMENTS BACKGROUND On April 4, 1995 the Mayor and Council requested that staff receive additional input from the Fort Worth League of Neighborhood Associations regarding public notice requirements for rezoning, platting, and Board of Adjustment actions. The League was contacted a second time for input and has responded(see attached correspondence dated May 19, 1995). Based on this input, staff offers the following recommendations for revision of the City's public notification requirements. NOTICE TO AFFECTED NEIGHBORHOOD ASSOCIATIONS A courtesy notice will be provided to a registered neighborhood association affected by a proposed application. This notice will be provided within one week of the filing deadline. The notice will include the owner's and/or agents name and address,location map,type of application, and the name of the assigned project manager. A neighborhood association must register with the Applications Division, Department of Development and provide a description of the association's boundaries, current contact person(s), and pay an annual fee of $5.00. These notices will be provided as a courtesy to the registered neighborhoods, and will not be considered legal notices. EXPANDING RADIUS OF MAILED NOTICES The radius of mailed notices for the Plan Commission, Zoning Commission, and the Board of Adjustment will be expanded from 200 to 300 feet. A 500-foot notice radius shall be provided for uses in the zoning ordinance that may not be located closer than 500 feet to a residentially zoned property, such as hotels/motels, pawnshops, parole/probation offices, and variances involving sexually oriented businesses. POSTING OF SIGNS FOR BOARD OF ADJUSTMENT HEARINGS It is not recommended that signs be required for Board of Adjustment variance requests. (Signs are already posted for Board of Adjustment special exception requests and rezonings.) Staff believes that a courtesy notice to the affected neighborhood association and an expanded notification radius should provide necessary notification. NOTIFICATION OF SCHOOL DISTRICTS Current policy provides notice to affected school districts for all preliminary plats and for other actions where school district property falls within the mandatory notification radius. In addition, the Mayor and Council should direct staff to implement a system for registration of interested neighborhood associations to receive a courtesy notice for cases filed with the Zoning Commission,Board of Adjustment,and the Plan Commission. As noted above, this registration will require payment of an annual fee of$5.00. We agree with your recommendation of 300 feet, rather than the current 200 feet in most cases. However, we believe that for those few items(such as hotels/motels, halfway houses, etc.) requiring public hearing, residents within 500 feet be notified. Currently for Zoning and Special Exceptions we agree additional signage for variances would not be practicable. We would recommend neighborhood notices use Dallas' early warning system_ We understand this system matches applications with the Mapsco number of registered neighborhoods and a copy of the application would be mailed immediately upon receipt. This would give a neighborhood between 4 and 6 weeks notice which would be sufficient time to meet with the applicant and call a neighborhood meeting to determine what impact the application might have on the area. The normal 10 day notice should also be mailed. This method would keep city staff and mailing costs to a minimum FWLNA current costs is$35 per notice. The FWLNA represents about sixty neighborhoods, but there are 133 known neighborhood associations, advisory councils and homeowner groups in Fort Worth.
