HomeMy WebLinkAboutOrdinance 15482®R®'N~NCE No. ISM Sz- AN ORDINANCE VACATING AND EXTINGUISHING A 20-FOOT WIDE BY 114.54-FOOT T LONG DRAINAGE EASEMENT LOCATED WITHIN LOT 12, BLOCK 12, PHASE 1, SECTION 2-B, LASATER ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the 20-foot wide by 114.54-foot long drainage easement, containing approximately 0.051 acres of land, and located within Lot 12, Block 12, Phase 1, Section 2-B, Lasater Addition, an addition to the City of Fort Worth, Texas, and as recorded in Cabinet A, Slide 7761, Plat Records of Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described partially vacated drainage easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect upon adoption. DISCUSSION: Pulte Homes of Texas, L.P., owner of the above-described property, has requested vacation of the referenced drainage easement to expand a building area. There are no known utilities in said. easement. The Engineering Department, Real Property Services Division, states that a fee of $1.00 will satisfy the public interest. Reviewing City departments and public utility companies have raised no objections to this request. An acceptable replat has been provided (FS-02-264). This property is located in COUNCIL DISTRICT 2. - . FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that this action will have no material effect on City funds.
