complete the same in accordance with the Confract Documents or fo take charge of and complete the work in such
a manner as it may deem proper, and if, in the campietion thereof, the cost to the said City shall exceed fhe

deliver to said City of For� Warth gaod and sufficient surety bands for the faithful performance of the terms and
stipulations af the Contr�ct and for the payment to alE claimants for labar andlor materials furnished in ihe
prosecutian of the work, suc� bonds being as provided and required in Texas Gaverriment Code Seciion ���3,
as amended, in the form include� in the Contract Documents, and such bands shall be One Hundre� Percent

RECOMMENDATION:
It is recommencied that the City Council �uthorize the City Manager to execute a contract w'rth
Peachtree Gonstruction, Ltd, in the amaunt of $G17,615 far 65 working days for HMAC (hot mix
as�haltic concrete) Surface Overlay 2003-10 at Various Locations.
DISCUSSION:
In #he FY�Dq2-2003 Contract Major Maintenance Pragram, �arious types of street maintenance
techniques are grauped in#a specific contrac# packages. HMAC Surface Overlay 2aaS-10 at Various
Locatians provides for surtace and base rehabilitation, curb and gutter, and valley gutter replacements
#ar asphalt streets funded from the Cor�tract Street Mainter�ance Fund. Where can�truction of new
valley gutters is n�cessary, 1998 Capital Improvernent Program miscellaneous small concrete funds will
be used.
