That in addition to thase amounts allocafed io the various Ciiy deQartmen#s for Fiscal Year 20D2-
2003 9n the Budget of the City Manager, khere shall also be increased estimated receipts and
appropriatinns in the Environmental Management Projec# Fund in the amount af $200,000 from
a�ailable funds for ihe purpose ofi funding a contract with Infrastructure Services, Inc. for street
sweeping services.
SECTION 2.
TF�at should any portion, section or pa�t of a section af this ordinance b� declared in�alid;
inoperative or void for any reasan �y a courE of compete�f jurisdiction, such decision, apinion ar
judgment shall in no way irnpair the, remaining parEions, sections, or parts of �seciians of #his

SECTION 3.
9 That this ordinance shall be cumulative of �rdinance No. 1518�4 and all other ordinances and
apprapriatians amending the sama exce�t in thos� instances where the pravisions of this ordinance

A. The Contractor shall provide its own equip�nent, iabor, fuel, safety equipmeni and
any other materials necessary to complete the required work. The Cantractor shaEl
be respansible for main�enance and repair of its own equipment and the a�ailabiGty,
pres�nce, competence and s�apervision of i�s employees.
6. TF�e Contractar is required �o have an experienced artd competent
supervisor/for�rnan wifh each work group at all times, wha may be a working
foreman operating a street sweeper.
C. Th�re shall be no subcontractors used by the Contractor to fulFll ar�y items or
conditians of tha Contract withaut th� pri�r written cansent of the City.
D. No cfeaning operations shall be conducted when there are climatic canditions
� presented ar forecast that wauld malce sUc� an aperation ineff�ctual or �angerous,
incEuding, but not �imited to, heavy rains, ice and slee�. For the purpose of #his
Contraci, the Nationa! Weather Serv�ce {NWS) shall be the weather forecasting
and reporiing agency. Forecasf by the NWS shall be deemec4 to extend for a
period af anEy twelve �12} hours. Notwi#hstanding anything to the contrary, the
Transportation and Public Works Department shall ha�e the final decisEon on
�' whether ar not cleaning operations are ta be pe�farmed.
E. The Contractor may suspend operatians if canditions are such t�at cleaning
operations cannot be carried out in an effective manner. If suspension occurs, the
Contractor shall immediately nokify the Street Superintendent or his designee.

#he cleaning operation shall be the responsibility af the Contractar. AA applicab{e State and
local faws and ordinances related #a #he hau[ing, handling, and di5posal of such maierial shall
be complied with by the Contractor. In flrder to comply with En�ironmental Pratectior� Agency
(EPA) regulations, the City must track tf�e amount of debris remaved from tf�e street system.
Tl�e Confractor shall keep an accurate log of the weight, valume, number of truekloads and the
date of disposal for all collected debris. A copy of the Iog informatian shall be suhmitted to t#�e
City afo�g with each monthly invoice.

Contractor shall advise the Director af the Department of Engir�eering, acting as the City of
For� Worth's Flood Plain Administrator ("Administrator"), the location af all sites wher� the

until the proposed sites have been deiermined by ihe Adminis#rator to meet the requirements
of th� Fload Plain O�dinance of the City of Fort Worth (Ordir�ance No. 10056) and a f�ood plain
permit issued. All disposal si�es must be appro�ed by the Administrator to ens�rre the filling is
not occurring within a flood plain withaut a permit. A flood plair� permit can be issued u�on
approval of necessary engineering studies. No �II permit is requirad if disposal sit�s are not in
a#lood plain. Appraval of the Contracfor's disposal sites shall b� evicf�nc�d by a le�ter sign�ci
by fhe Administra#or stating that the site is not in a known flood plain or by a F[ood Plain Fi[I
Permit authorizing fill within the fload plain. Any expet�ses associated with abtaining #he fill
permit, includir�g any r�ecessary engineering studies, shal! be at Con#ractor's expense. ln #he
event that the Contractar disposes of spaillfill material a# a site without a fill permit or a letter
from the Admir�istrator appro�ing the dispasal site, upon no#ification by the Director of the
Department of Engineering, Contractor shall r�mov� the spai�/fl! material at its expense and
dispose of such materials in accorciance with tfie Ordinance of �he City and tF�is section.
7. This Cantract is governed by the two pubiished specifications, except as modified by these
Special Provisions: �nciarci 5�prificationG for Street and �torm Drain Ganstrla�ion-City of
Fort Wolth, and Standard S�cifica_tionG far P�blic WorkG GonGtr�cfion-Na�th Cenfral Texas

service trucks, iire trucks and any other item of equEpment necessary to
provide cleanir�g services as described in these specifications.

Street sweepers used in tl�e clean9ng operation may be brushlvacuum, machanical or
regenerative air, ar may be a combinatian of iypes. Either type of unit may be used, but street
sweepers can be no nlclPr than five (,5y ye� unless the equipment has been completely
rebuil� within one (1) year prior to the starting da#e o� the Contract. Upon request of the City,
Contractor sha[I pro�id� documen�ation of the age of equipment ar satisfacfory evidence that
the equipment ntherwise meets the requirements o� these speci�caiions.
All street sweepers used must hava a rninimum capacity af four (4) cubic yards and be
equipped with an adequa�e water system for dust cantrol. All strset sweepers must F�av� dual
steering and dual hrooms. A!I equipment, including suppor� equipmsnt, must be equipped with
twa-way radio cammunication design�d for commereial use. Citizen Band Raciios are
�naceeptable. All equipment, including support equipment, that will be used by the Contractor
must be listed as part o# tF�e "Work Plan" in the Contrac�or's InformatiQn Report. All such
equipment is subject ta the apprava! of ti�e City. Such appro�af may require an on-site
demonstration of the capability of any proposed sweeping equipment prior io the award af the
Contract.
, Contractor's service facility must be located within the Met�oplex at a locaiion satisfactary to
the City and be a reaso�abl� dis#ance from the site af the proposed work. The service facility
must be adequate to insure routine maintenance and the Contractor shall be required io
maintain a sufficient supply of braams and replacement parts ta insure continuaus clean�ng
operations.
All �ehicles used by the Contractor must be pertormance worthy by .visual and operatianal
inspectian. Street sweepers must be washed once per day, inclement weather excepted, and
, a1l other equ�pment rnust be washed a minimum of once ��r week. The City shall have the
option to perform a complete inspectifln of all vehicles used by the Contractor at any time
� tf�roughout the term of ihe Contract. Should any vehicle, when inspected, and in #he
determination of ti�e C�ty, not meet the standards that the City feels necessary to camplete f�e
, Contract, ar to op�rate safely, the City may require that such vehicle be brought to standard
before being placed back in service. However, nothing cantained h�rein shaEl impose any duty
or obligatian on Gity to inspect, disco�er and correct, cure or rapair; or cause to be corrected,
` cured or repaired; any defect, malfunction or dangerous conditian af Canirac�or's equipment as
such duty or obligation is the sole respor�sibility of Contractor, and there is no intended third
, patty beneficiary fa this cor�tract.
9. SdF'ETY_ A[I equipment used in the street sweeping aperations shall be equipped in
� accordance with Stat� law, as s�ch may be amended from time to time, and shall be equipped
with a frant rriount�d flashing light with fhe following characteristics:
A. Visible for a minimum of one (1) mile.
B. Flash sixty {60) to ninety (94} times per minute.

C. Mounted for three hundred sixty (360) de�ree visibility.
D_ Equ9pped with an amber lens.
Also, rec}uired is a rear maunted Type B flashing arraw panel, minimum size 30" x 60", in
accardance with the Texas Manual on Unifarm Traffic Control Devices (TMUTC), latest edition.
Ti�e safety af the public and the con�enience of traffic sfi�all be of prim� impartance, but are not
third party t�eneficiaries to this contract. Unless otherwise provided in these specifiications, al1
portions af all streets shall be kept apen to traffc at all times tF�raughout sweeping operations.
Provisions for direciing traffic will not be paid for by the Ciiy, but shall be cansidered as
subsidiary work to the various bid items for stteet cleaning and sweeping services. The
Cantractor's �quipment shall move in the same directian as trafFic at alf times during all
cleaning and sweeping operatior�s.

Cify that they po�sess all nf the necessary eguipment, facilities, financial resourc�s, work
experience and personnel artd to fulfill the terms of the Cantract at the time of bid submission,

of the Gity's intent to award #he contract. Con#ractors submitting a bid mUst also complete the
Contractor's Informaiion Report included in the Proposal. This repart must d�mons�rate #he

A. Satisfactory evidence thai the Contractor passesses either through owne�ship or iease or
has made arrangements to acquire all khe necessary equipment as sp�cified herein, with
the c��tificatian �hat such equipment is not obligated for ot#�er contractual obiigations within
the scope of the Contractor's prior existing operatians.
B. Satisfactory evidence tha� the Cantractor �as adequate financial resources, experienced
personnel, proper facilities and an adequate work pfan to complete the work as specified.
C. Satisfacfory evidence that tha Contractor has operated or is ❑p�rating a municipal str�et
cleaning system of the types and to the e�ent as outlined in the specifications and that the
Contractor has successfully conducted such an operation far a period ofi not less than two
(2) years within the fast five (5} years.
Failure to provide comple�e Confracfor's Information F�eport with a bid will disqualify
any such bid as nan-responsive, and such bid will not be considered,
The evaluation of bids ancf the determinatian of canforrtiity and acceptability shall be the sole
responsibifity o� the City. 5uch d�termination shall be based upon the information �urnished by
the Contractor with its bid, as well as other i�farmation that is reasonably available to the Ciky.

Sweeping list which wiil be the basis for:
A. Contracto�'s Cfeaning Route (s):
B. The City's inspec#ian af cleaning.
C. The inv�icing of cleaning cyc�es completed; and
� D. Payment by the City far services rendered.
Quantities af work to be perforrr�ed wili be determined jointly by the City and the Contractor at
the praject initiatic�n meet�ng after award of contrac�. The City will inspect #he Contractor's
performance and report in r►vriting any deficiency within twenky�faur (24) hours after eompletion
of work. Alf such deficiencies shall b� corrected by the Cantractor no later than �48 haurs {2

days} fo[lowing rece�pt of such natice.
The inspector shall maintain a manthly Iog of .the Con#ractor's completed worfc and will �erify
completion of the Contractor's work with the Contractor monthly.
In addition to the stated pracedure for v�rification of worlc performe� as described herein, the
Contractor shati lend whate�er nec�ssary assistance the City may request with respect to
verification of work perfarmed.

the City's satisfaction or a street no# swept at all, etc.} within two (2) days afte�r reeeipt af notic�
af such failure (written or verbal communication} from the City. �n the evenf the Contractor fails
to correct a�y "Failure ta Perform" item to the satisfaction of the City within the time specifietf,
or such greater period as the City may perrnit, the City shall have all righ#s accordeci �y law,
including the righ� to terminate ihe Contract. All cvsts and attomey's fees incurred by ti�e City
in the enfnrcement o# any provision herein or within this document shall be paid by tl�e

17, T�RMI�ATION: The City may, at its option, wEthouk prejudice ta any ather remedy a�ailable at

the express understanding that all services being terminated shall cease upon the date such
nQtice is received. In such event, the Contractar shafl not be entitled to damages of any nat�re
for such terminat9on, including but nof kimited to anticipated profits or consequential damages.

this Contract, then the City inay withhold payment of any amount otherwise due and payabie to
the Contractor under this Contract. Any amount so withheld may be retained by the City fior

after written notic� to �he Contractar apply such money in satisfaction af any ciaim(s). This
provision is inter�ded solely for the benefit of the City, and �o other person or antity shall hav�
any right or claim against the City by reason of the City's failure or re�usal to with�old monies.

the Cantractar shall submit to the City an in�oice fior the units of the services pro�ided (Section
11 } from the tirst day to the last day of the preceding month. A copy of the Raute Lists for the
invaiced period showing th� date each street ►rvas cleaned, �he tota{ mileage for #he pariod,
initials andl�or signatures �f the Contractar's representati�e and the Director's representative
�� must accompany the invQiee. On or before t�e #enth (1 ath} day of the next month, the Cify

establishes a short-term program under which the Federai
Goverrtment will share in the paymen� of covered losses caused
