Dear Sir:
Plcase be advised that the City Councils of the City of Fort Worth, Texas,
and the City of White Settlement, Texas, have reviewed a joint contract
between the aforementioned authorities covering the construction of a major
sanitary sewer outfall line. The contract is numbered "City of Fort Worth
Contract No. 6216 (West Fork Collector, Unit 6)"and states, in part:
"The City of Fort Worth, during its review of preliminary
project engineering plans may extend the project to include
areas beyond those contained in the original agreement,
with the City of Fort Worth to pay the cost of such pro-
ject additions."
The respective City Councils have directed the appropriate signature autl-o_i„ies
to execute this letter of agreement confirming the construction of two 18 inch
sanitary sewer lines across right-of-way for proposed Interstate Loop 820 t_d
within the corporate limits of the City of Fort Worth as part of the sanitary
sewer project covered by Contract No. 6216 between the two cities.
The necessary Utility Joint Use Agreement between the City of Fort Worth and
the Texas Highway Department is also forwarded to allow the subject construction
to be completed in accord with policies and regulations of the agencies concerned.

On.February..17, 1969, (M&C.C=1410), the City Council approved contract No.. 6216
with the City of White Settlement to construct the West Fork Collector Sewer,
Unit 6, across the City of White Settlement to its.western boundary. The
City of White Settlement and the City of Fort Worth agreed to participate in
the construction costof this collector sewer on a percentage.basis.relating
to the acregge served in each City.
.Extension. of Project

Contract No. 6216 provided that the City. of Fort Worth, during .its.review of
the Preliminary Engineering Plans, could extend the projectatitsexpense
to include areas beyond those contained in the original agreement. During
the project plan review in September, 1969, it wasdetermined.to.be in the
City of Fort Worth's best interest to extend the project across proposed
Interstate 820 at two locations for the following.reasons:
1) To obtain the benefitof lower unitprices which canbe anticipated
on a project. of this size;
2). The costs for the more,stringen.t material and backfill requirements
of the Highway Department havebeenavoidedby acquiring the.neces-
sary easements prior to the Highway Department buying the right-of-
way for I-820; and
3) Construction. of .the two required crossings, as,part of the. West Fork
Collector, Unit 6 contract, makes..them.eligible for Federal Grant
participation on the basis of 33 per cent of cons.truction.costs.
Cost of Proposed Extensions
Since no additional acreage within the.City limits of. White Settlement would
be served by the proposed extensions,,the City of. White.Settlement will not
participate intheir cost.. It is.estimated.that the..905 L.F. of 18-inch
sewer crossings involved will.cost approximately $10.,000, if constructed in
advance -of the Highway right-of-way acquisition... The same.installations would
costapproximately.$20.,000.if installed after Highway right-of-way acquisition
due to the morestringent requirements.imposedby. the. Highway.Department.
After deducting the Federal Grant participationofapproximately.$3,300., the
net cost to the City of Fort Worth will be approximately.$6,700 to construct
these crossings under the .White.Settlement.contract,.as.opposed.to,approxi-
mately $20,000 to accomplish the same.crossings at a later date.
The City of White Settlement was authorized in late.1.969 to proceed with plans
for the West Fork Collector., Unit 6., extension to include.the.Interstate.820
crossings.. The Federal Grant offer on.'this project subsequently,obtained.by
the.City of White. Settlement was based.on .the.project.cost including the two
Interstate crossings.

Highway Department Participation in. Cost
After the easements forthetwo future. Interstate. crossings, had. been. secured
by the_City of Fort Worth, the Texas State Highway Department acquired the
property containing the easements for the right-of-way of Interstate 820.
The Highway Department then requested the City of White Settlement to amend
its contract documents to require the use of cast iron pipe for the Interstate
820 crossings and to include a more stringent backfill requirement on this
portion of the collector sewer. The Texas Highway Department agreed to pay
the additional cost resulting from these stricter construction and material
requirements. A formal agreement providing for this cost participation by
the Texas Highway Department in this installation is currently being negotiated
with the City of White. Settlement. As part of this negotiation, the Texas
Highway Department has requested a.specific agreement between the two cities
providing for the City. of White Settlement to act as the contracting agent
for the City of Fort Worth in the construction of the Interstate 820 crossings.
The Highway Department has also requested the City. of Fort Worth to execute
a standard "Utility Joint Use Agreement" permitting the Highway Department to
construct Interstate Highway 820 across the easements obtained by the City of
Fort Worth,
Recommendation
It is recommended that:
The City Manager be authorized to execute an agreement between the
City of White Settlement and the City of Fort Worth, confirming the
constructionof the Interstate 820 crossings as part of the sanitary
sewer construction projectcovered by Contract No. 6216.between the
two cities, and '
2. That the City Manager be authorized to execute the. standard "Utility
Joint Use Agreement" enabling the. Texas Highway Department to enter
upon the City of Fort Worth's easements for the purposes of construct-
ing, operating and maintaining Interstate Highway 820 across the
West Fork Collector, Unit 6 extension, west of the City of White
Settlement.
