Home My WebLink AboutContract 50312-A7CSC No. 50312-A7 AMENDMENT No . 7 TO CITY SECRETARY CONTRACT No. 50312 WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc., (ENGINEER) made and entered into City Secretary Contract No. 50312, (the CONTRACT) which was authorized M&C C-28566 on the 30th day of January, 2018, in the amount of $3,099,361.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No.l in the amount of $229,755.00 authorized by M&C C-29067 on March 19th, 2019, Amendment No.2 in the amount of $366,004.00 authorized by M&C C-29178 on June 25th, 2019, Amendment No.3 in the amount of $211,344.00 authorized by M&C 20-0137 on March 3rd, 2020, Amendment No.4 in the amount of $392,668.00 authorized by M&C 20-0460 on June 23rd, 2020, Amendment No.5 in the amount of $323,249.00 authorized by M&C 22-0290 on April 12th, 2022 and Amendment No.6 in the amount of $1,511,941.00 authorized by M&C 24-0844 on September 17, 2024; and WHEREAS, the CONTRACT involves engineering services for the following project: Lake Arlington Lift Station and Force Main, CPN 100995; and WHEREAS, it has become necessary to execute Amendment No. 7 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $99,932.00. 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $ 6,234,254.00. 3. (FNI) is providing this proposal to amend the Engineering Design Services and Construction Services for the Lake Arlington Lift Station and Force Main (City Project Number 100995). The following scope and fee includes the costs for additional permitting, archeological survey, resetting control points for construction staking, and construction representation. FNI records show that this proposal would serve as Contract Amendment No. 7. Task 1— Permitting Updates includes an additional archaeological survey and separate USACE PCN for the bank stabilization at the Village Creek Tributary. The site eroded significantly during the initial schedule delay and the extents of the stabilization need at the existing aerial crossings increased. The bank stabilization PCN is being provided separately from the force main to avoid delaying force main PCN and its construction. Task 2 — Construction Staking includes resetting the control points for the construction survey which were lost or removed by others during the schedule delay. Task 3 —Tunneling General Rep includes bid and construction phase services for to support construction administration and walk-throughs for tunnel design additions that were made throughout the project. Those additional design fees did not include bid and construction phase effort. Task 4 — Includes effort for attendance and exhibits to support the condemnation hearing for parcels 43, 46-47.
