HomeMy WebLinkAboutContract 61154-A1Date Received: 6/6/2025 Permit No.: SWFMA-25-0034 Time Received: 8 : 23 a.m. City secretary No.: 61154-Al FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 61154 STORMWATER FACILITY MAINTENANCE AGREEMENT This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 61154, STORMWATER FACILITY MAINTENANCE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County, Texas, acting herein by and through its duly authorized City Manager or duly designated Assistant City Manager, hereinafter referred to as the "City", and LENNAR HOMES OF TEXAS LAND AND CONSTRUCTION, LTD., a Texas limited liability partnership, herein after referred to as "Lennar Homes," and Sendera Ranch Master Association, Inc/Senders Ranch Single -Family Area Association, Inc. both Texas nonprofit corporations, herein referred to as "Associations." RECITALS WHEREAS, on March 20, 2024, the City, LNR AIV, LLC, and Associations, made and entered into City Secretary Contract No. 61154 (the "Agreement"), to authorize the use of on -site stormwater management facilities (the "Facility") to be constructed and maintained on a portion of property owned by LNR AIV, LLC; and WHEREAS, Section 8 of the Agreement states the Agreement constitutes a covenant running with the land that is binding on LNR AIV, LLC, its administrators, executors, assigns, heirs and any other successors in interest; and WHEREAS, the Agreement was recorded with the property records of Denton County, Texas as Document No. 2024-29702 which is one and the same as City Secretary Contract 61154. WHEREAS, LNR AIV, LLC sold and conveyed the property subject to the Agreement by Special Warranty Deed to Lennar Homes, which is now the current Landowner (the "Conveyance"); OFFICIAL RECORD Revised 03/01/2022 BN CITY SECRETARY Page 1 of 8 FT. WORTH, TX and WHEREAS, on October 30, 2024, the Conveyance was recorded with the property records of Denton County, Texas as Document No. 2024-117771; and WHEREAS, LNR AIV, LLC and Lennar Homes did not execute a Consent of Assignment to the Agreement at the time it executed the Conveyance; and WHEREAS, Lennar Homes desires to amend Exhibit A and B to the Agreement because the abandoned area is being converted to residential lots, thereby negating the need for a public channel and thus changing the scope of the Facility; and WHEREAS, the Agreement contains exhibit(s) "A" and "B" that depicts the location and redesigned specifications of the Facility; and WHEREAS, this Amendment is entered into by and between the City, the Associations, and Lennar Homes to memorialize that Lennar Homes is the successor in interest to LNR AIV, LLC, amend references to Landowner to clarify that Lennar Homes is the current landowner, and update the location and facility exhibits under the terms of City Secretary Contract No. 61154 to reflect that part of the abandoned area is being converted to residential lots; and NOW THEREFORE, City, Lennar Homes, and Associations, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. The City and Associations agree that LNR AIV, LLC conveyed the property described in Exhibit "A" to Lennar Homes on October 30, 2024. The City and Associations agree that Lennar Homes is the successor in interest to the Agreement. As the successor in interest to the Agreement, Lennar Homes shall perform all obligations described therein pertaining to the Landowner. Revised 03/01/2022 BN Page 2 of 8 2. The Agreement is amended to repeal all references to LNR AIV, LLC are amended and to be read as "Lennar Homes." The Agreement is amended to clarify that all references to Landowner are to be read as applicable to "Lennar Homes." 3. Exhibit A is hereby replaced with Exhibit A-1 attached hereto and incorporated herein to the Agreement, consisting of a revised location description of the Facility. 4. Exhibit B is hereby replaced with Exhibit B-1 attached hereto and incorporated herein to the Agreement, consisting of revised design specifications of the Facility. 5. This Amendment shall be filed with the City Secretary as an amendment to the Agreement and also recorded among the land records of Denton County, Texas, and shall constitute a covenant running with the land, and shall be binding on the Landowner, its administrators, executors, assigns, heirs and any other successors in interests, including any property owners association. 6. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect. EXECUTED on this the 6th day of June 2025. General Maintenance Procedures The structural and functional integrity of the Facility shall be maintained at all times by removing and preventing drainage interference, obstructions, blockages, or other adverse effects into, through, or out of the system. Periodic silt removal shall occur when standing water conditions occur or the pond's storage volume is reduced by more than 10%. Silt shall be removed and the pond/basin returned to original lines and grades I shown on the approved engineering plans. In addition, corrective measures are required any time a basin does not drain completely within 72 hours of cessation of inflow. NO STANDING WATER IS ALLOWED in basins designed for dry detention purposes. Accumulated litter, sediment, and debris shall be removed every 6 months or as necessary to maintain proper operation of the basin. Disposal shall be in accordance with federal, state and local regulations. Detention facilities shall be mowed monthly between the months of April and October or anytime vegetation exceeds 12-inches in height. To prevent debris from entering and clogging the downstream storm sewer system a wire mesh screen or similar screening device shall be installed over the outlet until final acceptance. 4. PREVENTIVE MAINTENANCE/INSPECTION • Visual inspections of all components will be conducted every 6 months. • A log shall be kept of maintenance actions, and inspections. The log should document the condition of the detention system's primary components, mowing, and silt, litter and debris removal dates. Document aeration of the basin bottoms and replanting to prevent the sealing of the basin bottom. • Written maintenance and repair records shall be maintained by the party or parties signing the attached Agreement and shall be provided to the City upon request.
