HomeMy WebLinkAboutContract 62396-A1CSC No. 62396-Al AMENDMENT No . 1 TO CITY SECRETARY CONTRACT No. 62396 WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates, Inc. (ENGINEER) made and entered into City Secretary Contract No. 62396, (the CONTRACT) which was authorized by M&C 24-0998 on the 12th day of November, 2024, in the amount of $679,146.00; and WHEREAS, the CONTRACT involves engineering services for the following project: Sendera Ranch Ground Storage Tank CPN 105781; and WHEREAS, it has become necessary to execute Amendment No.1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $97,680.00. 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $ 776,826.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. OFFICIAL RECORD CITY SECRETARY FT. Project Manager City of Fort Worth Water Department 200 Texas Street Fort Worth, TX 76102 Re: Sendera Ranch 5.5 MG Ground Storage Tank Amendment No. 1 KHA No. 061018480 City Project No. 1057811 City Secretary No. 62396 Dear Ms. Johnson: The City of Fort Worth (CITY) has requested that Kimley-Horn and Associates, Inc. perform additional services under Amendment Number 1 for the SENDERA RANCH GROUND STORAGE TANK project. During Preliminary Design, it was determined that the CITY did not have adequate deeded access to their pump station facility. After further discussion, the CITY notified the ENGINEER of a land dedication to the CITY that had failed to take place upon the execution of a development agreement. The CITY requested the ENGINEER perform additional services to assist in the procurement of the adjacent property and construction access easement. In addition, the CITY requested the ENGINEER to design a new CMU wall inside the existing pump station building to provide better protection for the electrical room. During design, it was discovered that the existing yard piping contained an impressed current cathodic protection system. Cathodic protection design was not included in the Original Contract, so design was added to the construction plans. Upon advertising the project for bidding, the CITY requested site observation services to be performed during the construction. These additional services are further described as follows: TASK 4 — FINAL DESIGN: $9,320 ENGINEER will complete the following additional tasks not included in the Original Contract: Preparation of Construction Documents for a new CMU partition wall to enclose the electrical room within the existing Sendera Ranch Pump Station building. • Development of the Construction Documents shall include the following: • Architectural Plan and Details including the following: Dimensions, architectural details, section views, and door schedules for the new CMU wall to be installed within the existing pump station. • Pump Station Modifications including the following: Required reinforcement of the new CMU wall including proposed tie-ins to the existing structure. • Develop special technical specifications for the CMU wall not included in the City of Fort Worth's Standards or will modify the City of Fort Worth's Standards as necessary. Kimley»>Horn Page 2 TASK 6 — CONSTRUCTION PHASE SERVICES: $81,650 ENGINEER will complete the following additional tasks not included in the Original Contract: • Site Observation • ENGINEER will be on site for an average of approximately 4 hours per week to perform site observation. Site observation will be scheduled based on Contractor activities at the site. Site visits will follow the guidelines established in the original contract. Site visits will be documented with observation reports to include a description of work in progress and any observations of construction issues that may require attention. City and Contractor Coordination • ENGINEER shall coordinate with CITY and the Contractor on an as -needed basis regarding project documentation, the project schedule, and known project issues. The purpose of this coordination will be to facilitate communication and resolution of outstanding items to promote progress of the project during construction. Limitation of Responsibilities • ENGINEER shall have no responsibility for any contractor's means, methods, techniques, equipment choice and usage, equipment maintenance and inspection, sequence, schedule, safety programs, or safety practices, nor shall ENGINEER have any authority or responsibility to stop or direct the work of any contractor. ENGINEER's visits will be for the purpose of endeavoring to provide the CITY a greater degree of confidence that the completed work of its contractors will generally conform to the construction documents prepared by ENGINEER. ENGINEER neither guarantees the performance of contractors, nor assumes responsibility for any contractor's failure to perform its work in accordance with the contract documents. • ENGINEER is not responsible for any duties assigned to it in the construction contract that are not expressly provided for in this Agreement. The CITY agrees that each contract with any contractor shall state that the contractor shall be solely responsible for job site safety and its means and methods; that the contractor shall indemnify the CITY and ENGINEER for all claims and liability arising out of job site accidents; and that the CITY and ENGINEER shall be made additional insureds under the contractor's general liability insurance policy. TASK 7 — SURVEYING AND SUE SERVICES $6,710 ENGINEER will complete the following additional tasks not included in the Original Contract: • Perform an ALTA/NSPS land title survey on a called 3.471-acre and 5-acre tract of land adjacent to the existing Sendera Ranch Pump Station site. $25,000 of Additional Services was included in the Original Contract. These funds were applied towards the following sub -consultant expenses incurred for additional design: • Quorum — Architecture for the pump station interior wall - $5,000 • Black Mesa — Cathodic Protection Design - $12,130 Gorrondona and Associates — Access easement survey and easement document preparation - $7,870 Kimley»>Horn Page 3 We recommend that the CITY increase the budget by $97,680 for these additional services.
