ORDINANCE NO. ~ ~L~ AN ORDINANCE VACATING AND EXTINGUISHING A 10-FOOT WIDE BY 91.74-FOOT LONG UTILITY EASEMENT LOCATED WITHIN LOTS 33 AND 34, BLOCK C, THE COOKE'S MEADOW ADDITION, SECTION THREE, FORT WORTH, TEXAS, AND CONTAINING APPROXIMATELY 0.02 ACRES OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of a 10-foot wide by 91.74-foot long utility easement located within Lots 33 and 34, Block C, The Cooke's Meadow Addition, an addition to the City of Fort Worth, Texas, containing approximately 0.02 acres of land, and as recorded in Volume 388-111, Page 29, Plat Records, Tarrant County, Texas, and as more specifically described in Exhibit A, attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the~fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect upon adoption. APPROVED AS TO FORM AND LEGALITY: :,,.~. DISCUSSION: Homecoming Financial Net, acting on behalf of Bank One N.A:, owner of the above described properties, has requested vacation of the referenced utility easement to expand a building area. There are no known utilities in said right-of-way. The Engineering Department, Real Property Services Division states that a fee of $1.00 will satisfy the public interest. Reviewing City departments and public utility companies have raised no objections to ,this request. A replat is not required. This property is located in COUNCIL DISTRICT 4. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that this action will have no material effect on City funds.
