City of Fort Worth; and Reynaldo Sanchez, Individually Defendants Dear Attorney East, Court: United States District Court Nortlicn District of Texas Fort Worth Division Case No. 4:25-CV-00022-Y The Risk Management Division, of the Human Resource Department will be handling the administrative aspects of your representation of in the above captioned case. The purpose of this letter is to formalize your engagement as Officer Revnaldo Sanchez counsel pursuant to the Fee Billing Policies and Procedures for Counsel (attached), a Resolution of the City Council (attached) or the City of Fort Worth Personal Liability Indemnity Plan (attached) and/or defense as provided through Chapter 180, Section 180.002 of the Texas Local Government Code. You are being retained to represent an individual who was an employee or official of the City of Fort Worth at the time of the incident complained of. You are being retained because of the potential of a conflict between the City of Fort Worth and the individual employee/official. Because you have not been hired to assist the Office of the City Attorney, City Council approval is not required to hire you at this time. This agreement does not in any way authorize you or your firm to enter into settlement agreements involving public funds. Any and all settlement offers and agreements involving the payment of public funds by the City of Fort Worth must be approved by the City Manager or by the City Council of the City of Fort Worth, depending on the amount of the settlement. You are not to perform services or incur reimbursable costs exceeding $100,000 on this engagement. Expenditures in excess of $100,000 will require City Council approval. WORTH, TX Exhibit B conflicts The City of Fort Worth expects the highest ethical standards in your representation Officer Reynaldo Sanchez. You and your firm must be free of conflicting interest. Please provide me with a list of potentially conflicting representations with your acceptance of this agreement or an affirmative statement that no potentially conflicting representation exists. Any potential conflict must be discussed with us as soon as you recognize its existence. Should a conflict or a potential conflict arise during your representation of Officer Reynaldo Sanchez, please notify the Assistant City Attorney assigned to this case immediately so that we may meet and resolve the matter. We reserve the right to decide whether an actual or potential conflict exists. If, in our opinion, an actual or potential conflict does exist, you will not be permitted to go forward with your representation until the situation has been resolved. / Certification Concerning Conflicts VZI have carefully reviewed the cases in which I am currently involved and certify that I do not have conflict in the representation of Officer Reynaldo Sanchez. Email: attison.tidwett@fortworthtexas.gov The City of Fort Worth will not pay for any costs relating to conversion of the firm's computer programming to comply with the City's fee bill processing or reporting requirements. The City of Fort Worth will not pay for secretarial or clerical time. The City of Fort Worth will not pay for charges relating to word processing or computer time, including Westlaw or Lexis access. 10. The City of Fort Worth will pay for photocopying at actual cost, which will not exceed $.15 per page. When feasible, large copying projects should be sent out to a copying service. Clerical time for photocopying will not be paid. We request that in multi -counsel cases for city employees the attorneys cooperate in copying items such as depositions to avoid high copy charges. 11. The City of Fort Worth will not pay facsimile transmissions, except for long distance fees. 12. Long distance telephone, overnight mail, and delivery charges will be paid at actual cost. These services should be used with restraint and only when necessary. The City of Fort Worth will not pay for ordinary postage charges. 13. Overnight travel must be approved in advance. Expenses for lodging and transportation should be incurred in a prudent marmer. Hotel accommodations should be moderately priced and expenses for luxury hotels or services will not be reimbursed. Charges for air travel will be reimbursed at actual cost or coach rate, whichever is less. A copy of all charges must accompany all requests for reimbursement. 14. Except during travel described above, we do not reimburse for the costs of meals. If business is conducted during a meal, appropriate time charges may be made at normal hourly rates, but charges for food, beverage, etc., will not be reimbursed. 15. The City of Fort Worth reviews each fee and expenses bill to determine the reasonableness of the charges and the necessity and cost-effectiveness of the service and/or expense. In this regard, we may from time to time ask for additional supporting information regarding your services. 16. You or your firm will provide the certification attached as Exhibit A with each of your bills.
