fQ,SWIMMING POOLS AND SPAS & ARTICLE XIX RECREATIONAL
AQUATIC SPRAY GROUNDS
This Informal Report provides an overview of text amendments to Chapter 16 Health and
Sanitation, Article XVII (Public Swimming Pools and Spas) and Article XIX (Recreational Aquatic
Spray Grounds). Text amendments are routinely needed to ensure the municipal code aligns with
state and federal laws. Proposed text amendments clarify definitions, update regulations by
reference, and assign regulatory authority to the Environmental Services Department.
Background
City Council approved Ordinance 16313 (Public Swimming Pools and Spas) on March 1, 2005,
and Ordinance 18521 (Recreational Aquatic Spray Grounds) on March 31, 2009. Proposed text
amendments to each respective ordinance seek to align the City Code with minimum state
regulations now and as amended in the future:
City Code Article XVII (Public Swimming Pools and Spas) references the Texas Administrative
Code, Title 25, Part I, Chapter 265 Subchapter L, Standards of Public Pools and Spas.
City Code Article XIX (Recreational Aquatic Spray Grounds) will reference Texas
Administrative Code, Title 25, Part 1, Chapter 265 Subchapter M, Public Interactive Water
Feature and Fountains.
Article XVII (Public Swimming Pools and Spas)
Proposed changes to Article XVII Swimming Pools and Spas will adopt minimum state
regulations by reference. The Article will retain four existing higher regulatory standards which
require: 1) a nationally -accredited pool/spa operator for municipal and competitive pools; 2)
approval of a licensed professional engineer on design and construction; 3) signage for
prohibiting diaper changing; 4) a patron to report any mechanical, safety, or water quality issues.
Article XIX (Public Interactive Water Feature and Fountains)
Proposed changes to Article XIX include renaming Recreational Aquatic Spray Grounds as Public
Interactive Water Features and Fountains to align with State terms. Changes will adopt minimum
state regulations that: 1) allow alternate water treatment technologies for supplemental
disinfection (e.g., ultraviolet light, ozone); and 2) continue to require alarm -based alerts without
secondary system shut-off devices. The Article will retain three regulatory standards that exceed
the minimum standards: 1) signage prohibiting diaper changing; 2) coliform water testing; 3)
requiring all water to pass through primary and supplemental disinfection.
