A RESOLUTION AUTHORIZING EYECTION OF AN ADVANCE FUNDING
AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION ;FOR
LOCAL GOVERNMENT MAINTENANCE OF RA 1I,ROAli PAVEMENT
MARKINGS AND SIGNS (OFF -SYSTEM)
WHEREAS, the Texas Department of Transportation ( TxDOT) has identified the RNSF Railway, Fort Worth and
Western Railroad, Union Pacific Railroad, T'EX RAIL, Trinity Rail Express highway -rail grade crossing list in the. City of
Fort Worth, by convening a Diagnostic Team comprised of interested parties of the Railroad, State and Local government
officials for an inspection; and
WHEREAS the Diagnostic Team found that the highway -rail grade crossing and approaches to the highway -
grade crossing are in need of upgrades for to be in compliance with Federal 1-Iighway Administration (F1-1 WA), Texas
Manual on Uniform Traffic Control Devices (TMLITC❑), American Railway Engineering and Maintenance of Way
Association (AREMA) and other industry standards; and
WHEREAS, 'Tx DOT has initiated a project with the Railroad and will seek funding for the project to bring the
highway -grade crossings into compliance with Federal, State and industry regulatory standards; and
1i HEREAS. at the completion of the project, City of Fort Worth, shall receive from 'Tx DOT at no cost, the
installed improvements that were installed on locally owned roadways and facilities as a part of the project, as locally
owned facilities; and
WHEREAS, after accepting the roadway signage and pavement markings as locally owned facilities, City o#'Fort
Worth agrees to maintain the installed roadway signage and pavement markings to the standards of the City of Fort Worth
and in compliance with the TMUTCD; and
WHEREAS, City of Fort Worth, authorizes an Advance Funding Agreement for Local Government Maintenancc
of Railroad Grossing Approaches (Off -System) with Texas Department of Transportation For the City of' Fort Worth to
maintain the installed improvements in the standards of the City of Fort Worth. The authorized representative of the City
of Fort Worth is authorized to execute all documents necessary to complete this transaction.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
That the City of Fort Worth City Council authorizes an Advance Funding Agreement with the State of Texas for
the maintenance of railroad crossing signs and pavement markings installed as shown on Attachment `A'.
The City Manager, or their designee, is hereby authorized to execute all documents necessary to complete this
transaction.
That it is hereby officially found and determined that the meeting at which this resolution is passed is open to the
public and that public notice of the time, place, and purpose of said meeting was given as required by Iaw.

(Off -System)
RECOMMENDATION:
It is recommended that the City Council:
Adapt a Resolution authorizing the execution of an Advance Funding Agreement with the Texas Department of Transportation for the City of Fort
Worth to maintain the installed roadway signage and pavement markings near the railroad crossings by the State Railroad Signal Program (Off -
System).
DISCUSSION:
The Texas Department of Transportation (TxDOT) has identified a list of highway -rail grade crossings in the City of Fort Worth and found that the
approaches to the highway -rail grade crossings need upgrades to be in compliance with Federal Highway Administration (FHWA) and Texas
Manua! on Uniform Traffic Control Devices (fMUTCD) standards.
TxDOT has initiated a project that will fund the construction to bring the highway -rail grade crossing approaches into compliance with Federal and
State standards.
At the completion of the project, the City of Fort Worth shall receive from TxDOT at no cost to the City the installed roadway signage and pavement
markings that were installed on locally owned roadways and facilities as part of the project.
After accepting the roadway signage and pavement markings as locally owned facilities, the City of Fort Worth agrees to maintain the installed
roadway signage and pavement markings to the standards of the City of Fort Worth and in compliance with the TMUTCD.
The work to upgrade railroad signs and striping funded through TxDOT Section 130 program for approximately 150 railroad crossings in Fort
Worth is expected to be durable and long-lasting in the field. Ongoing maintenance will be handled as part of the City Railroad Safety Program.
The City Railroad Safety Program currently has an annual maintenance budget of $100,000 from PayGo funding to support over 200 railroad
crossings citywide.
A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: TxDot

The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
