SUBJECT: Update on proposed Minority and Women Business Enterprise
(M/WBE) Ordinance
There were several issues and questions raised by City Councilmernbers during the pre-
council presentation on the proposed major changes to the M/WBE Ordinance. The
following information is provided to address these concerns:
• Councilmember Silcox requested a time-line for the City to initiate a timely invoice
payment process. The Departments responsible for the most invoices have been
identified by the City Manager; Aviation, Engineering, Finance, Parks and Community
Services, Transportation and Public Works and Water. This group will present a report
to the City Council in ninety days that will detail procedures necessary to vastly improve
the City's payment process to meet the time-line in the proposed Ordinance.
r Councilmember Moss requested that the "best value" criteria be detailed in the proposed
M/WBE Ordinance. it is staffs recommendation that the Ordinance language be added
to specifically refer to the state statute that detail the "best value" criteria. By referencing
the state statute and not adding the specific language, it will reduce the need to amend
the Ordinance each time the legislature amends or changes the "best value" language.
• The Executive Director for QUOIN (formerly known as Associated General Contractors
of America) spoke at the public hearing on April 15, 2003 concerning several issues the
organization has with the proposed changes to the Ordinance. The City Council
requested that he submit, in writing, language addressing these issues to staff by April
18, 2003. Staff has received verbal comments from the legal representative for the local
QUOIN division and a meeting has been scheduled that will also include the MWBEAC
Chair and the Law Department.
Any revision to the proposed Ordinance will be presented to the City Council at the pre-
council session on April 22, 2003.
