Ordinance No.18712-OT-2009 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $3,300,000.00, SUBJECT TO RECEIPT OF A GRANT FOR AREA LEAD, EDUCATION REDUCTION AND TRAINING PROGRAM (ALERT);PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2048-2009, there shall also be increased appropriations in the Grants Fund in the amount of $3,300,004.00 {$340,000.00 from General Fund) City's matching fund portion for the ALERT grant, subject to receipt of this grant for Area Lead, Education, Reduction and Training Program {ALERT}. SECTION 2. That should any portion, suction or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18253 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager to apply for and accept, if awarded, a grant far an amount up to $3,OOO,OQ0.04 from the United States Department of Housing and Urban Development far the Lead Hazard Reduction Demonstration Grant to be entitled Area Lead, Education, Reduction and Training Program with an "in-kind" match of at least 10 percent; 2. Approve the use of up to $300,000.00 from the City of Fort Worth's General Fund, Community Development Block Grant and Texas Department of Housing and Community Affairs grant funds as the City's matching fund portion far the Area lead, Education, Reduction and Training Program grant; 3. Adopt the attached appropriation ordinance increasing the estimafed receipts and appropriations in the Grants Fund by up to $3,300,000.00 subject to receipt of the grant; 4. Certify that the activities to be funded with the grant are consistent wifh the City's Consolidated Plan; and 5. Authorize the City Manager, or his designee, to enter into agreements, amend or extend such agreement with the Tarrant County Pubiic Health Department. the Fort Worth Housing Authority, area non-pro#it organizations and other entities as may be necessary and appropriate wifhin the scope of the program and in compliance with applicable laws and regulations. Housing is generally made lead-safe through use of interim controls, acost-effective treatment consisting of encapsulation of lead-paint surfaces and replacement of components such as doors and windows which have friction surfaces that can create lead dust. The average cost of treating homes in the City has bean approximately $8540 per unit. The Housing and Economic Development Department is now applying for an additional $3,404,044.00 grant, to be implemented over a three year period, to continue the ALERT program for the period from November 1, 2009, to October 31, 2012. City administrative costs associated with implementation of the program are limited to 10 percent of the grant The LHRD grant requires a 25 percent match. The Gity of Fort Worth is requesting a waiver to be given by HUD. If the waiver is granted, the City of Fort Worth wilt only be responsible fora 10 percent match requirement, which wili be met with funds from the City of Fort Worth General Fund in the amount of $304,000.00. If the waiver is not granted by HUD, the City of Fort Worth will not apply for this grant. Additional funds will be leveraged from the Emergency Repair Program, Home Improvement and Cowtawn Brush Up Programs funded with CDBG, and the Weatherization Program that is funded with TDHCA grants, for the period from November 1, 2409, to October 31, 2412. The Housing and Economic Development Department will coklaborate with the Tarrant County Public Health Department, the Fart Worth Housing Authority, area non-profit and community-based organizations and other relevant entities to ensure that appropriate outreach is conducted among all at-risk populations and neighborhoods. FISCAL INFORMATION 1 CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations, award of the grant and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund.
