ORDINANCE NO. ~~(~ AN ORDINANCE VACATING AND EXTINGUISHING A VARIABLE 45.39-FOOT WIDE BY 405.06-FOOT LONG DRAINAGE EASEMENT LOCATED WITHIN LOT 1, BLOCK 1, CALVARY ACADEMY ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the 45.39-foot wide by 405.06-foot long drainage easement, containing approximately 0.3664 acres of land, and located within Lot 1, Block 1, Calvary Academy Addition, an addition to the City of Fort Worth, Texas, and as recorded in Cabinet A, Slide 7065, Plat Records of Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the. above described drainage easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect upon adoption. APPROVED AS TO FORM AND LEGALITY: ~. DISCUSSION: Calvary Academy, Inc. of Fort Worth, owner of the above-described property, has requested vacation of the referenced drainage easement to expand a building area. Existing improvements includes a new school building, a gym, and storm water drainage. The .relocation of storm water facility has been handled through the Community Facilities Agreement process. The Engineering Department, Real Property Services Division states that a fee of $1.00 will satisfy the public interest. Reviewing City departments and public utility companies have raised no objections to this request. An acceptable replat has been provided (FS-01-069). This request is located in COUNCIL DISTRICT 2.
