ORDINANCE NO.27672=05=2025 AN ORDINANCE, VACATING AND EXTINGUISHING PORTIONS OF NORTH COMMERCE STREET, A SEVENTY-FOOT WIDE PUBLIC RIGHT -CIF -WAY, NORTH C_'A:LHOUN STREET, A SEVENTY-FOOT WIDE PUBLIC RIGHT-CIF-WAV, NORTHEAST 9TH STREET, A SIXTY - FOOT WIDE PUBLIC WIGHT-OF-WAY, AND A TEN -FOOT WIDE ALLEV ADJACENT TO LOTS 1-10, AND LOTS 11-20, BLOCK 40, NORTH FORT WORTH ADDITION, AN ADDITION TO THE CITY OF FORT WORTH ACCORDING TO THF_, PLAT RJECORDED IN VOLUME 63, PAGE 149, PLAT RECORDS, TARRANT COUNTY, TEXAS, AND TOGETHER CONTAINING APPROXIMATELY 155,963 SQUARE FEET OR 3.55804 ACRES OF LAND MORE OR LESS; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITE` COUNCIL OF THE CITY OF FORT WORTH, TEXAS; SECTION 1. r That portions of North Commerce Street, a seventy-foot wide public right of way, North Calhoun Street, a seventy-foot wide public right of way, Northeast 9th Street, a sixty -foot wide public right of way, and a ten -foot wide alley adjacent to Lots 1-10, and Lots 11-20, Block 40, North Fort Worth Addition, an Addition to the City of Fort Worth according to the plat recorded in Volume 63, Page. 149, Plat Records, Tarrant County, Texas, and together containing, 155,963 square feet or 3.5804 acres of land, as more specifically described in Exhibit "A" attached hereto and incorporated herein by reference, be and the same are vacated and extinguished. SECTION 2. That the easerents to the land in the above -described vacated portions of rights of way and alley are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing Utility easements be shall be retained by the City until such time all utilities located in the easements are relocated at the owner's expense. SECTION 4. Adopt the attached ordinances vacating a portion of Northeast 9th Street, North Commerce Street, North Calhoun Street and the alleys in Block 40, North Fort Worth Addition for a bypass channel to serve the U.S. Army Corps of Engineers Central City Flood Control Project; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DLI-$CUSSION: Kimley-Horn, on behalf of Tarrant Regional Water District (TRVVD)., has requested vacations of Northeast 9th Street, North Commerce Street, North Calhoun Street and alleys in Block 40 rights -of -way to serve as a bypass channel forthe. U.S. Army Corps of Engineers Central City Flood Control Project. The City Plan Commission recommended approval to the City Council of VA-25-006 at its meeting on April 30, 2025. The City Plan Commission also authorized a waiver of the Subdivision Ordinance requirements to incorporate these vacated rights -of -way in a replat prior to an ordinance being issued by City Council. The City of Fort Worth (City) originally obtained the above -mentioned rights -of -way through plat dedication. The City does not have any fee interest in the rights -of -way or own any property adjacent to the rights-0f--way and did not expend any City funds to obtain the rights -of --way. In accordance with the Cify's policy regarding street and alley vacation transactions for Mayor and Council Communication (M&C) G-15624, staff recommends waving the purchase price of this right-of-way. This project is located in COUNCIL DISTRICT 2. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
