HomeMy WebLinkAboutIR 8523 INFORMAL REPORT TO CITY COUNCIL MEMBERS No. 8523 Or Date: 09/09/03 ?� To the Mayor and Members of the City Council � c Page 1 of 1 SUBJECT: THE DISCIPLINARY APPEALS BOARD Staff is recommending that the term limits for Disciplinary Appeals Board members be expanded from two 3 year terms to three 3 year terms. The Disciplinary Appeals Board hears appeals from non-civil service employees who have been terminated, demoted or suspended without pay for more than ten (10) consecutive working days for disciplinary reasons. There are ten (10) positions on the Board. Members are appointed to overlapping terms of three years. Three (3) member panels are convened to hear appeals on an as needed basis. During FY 01/02 five hearings were convened. During FY 02/03 two hearings have been convened and one is currently pending before the Board. Finding qualified persons willing to serve on the Board has been a challenge. Typically hearings consume a full work day; occasionally hearings required two (2) or three (3) days to complete. r/ Currently seven (7) of the ten (10) positions on the Board are filled; however, the terms of six (6) of the members will expire on October 1, 2003; and, three (3) of these Board members will not be eligible for reappointment. Staff is proposing an amendment to the ordinance that will increase the number of times a member can be reappointed from two to three. All of the current Board members are willing to serve an additional term. Approval of this amendment will ensure that appeals will be convened in a timely manner. Unless the City Council has any objections, an M&C will be brought forward to amend the ordinance for terms for the Disciplinary Appeals Board. (This commission is exempt by Ordinance No. 8971 from the provisions of ' Ordinance No. 8750 regarding 8-nlernbar boards and length of terms of service.) Qualified voters of the City as set from time to time by the City Manager. APPOINTMENT:METHOD OF Appointed by the City Manager and confirmed by the City Council. As nearly as reasonably posmib|e, membership shall be fairly representative of both sexes and of various racial groups which comprise the employees of the City. Vacancies are filled for unexpired terms. TERMS OF OFFICE: Members are appointed to overlapping terms of three years. GENERAL POWERS AND DUTIES: The Board shall hear appeals submitted by an employee subject to the provisions of Ordinance Nos. 8480. 8923. and 11821 relative to suopemsion, dernotion, or diornioao[ after other-normal administrative appeals have been exhausted. An independent hearing officer may be designated and directed by the Board to conduct hearings on employee appeals. The Board or its designated hearing officer has the power to administer oaths, issue subpoemao, receive relative evidence, compel the production of books and papers relative to the hearing and question witnesses. Within ten days of the conclusion of the hearing, the Board shall forward its recommendation concerning the appeal to the City Manager for appropriate action.
