SUBJECT: INTERLOCAL CONTRACT WITH THE CITYOF ARLINGTON TO
ALLOW FOR INSTITUTION OF EMINENT DOMAIN PROCEEDINGS
Representatives of the City of Arlington recently approached the City of Fort Worth, Real
Property Management Office to request approval to take a fee simple interest in real property
located within the City of Fort Worth.
The City of Arlington presented plans to develop a major multi-purpose sports complex near
the intersection of Greenbelt Road and Green Oaks Road (Exhibit Attached). A parcel of land
necessary to complete the sports facility is located within the Fort Worth City limits. The Fort
Worth landowner and the City of Arlington have been unable to come to agreement
concerning the value of the property interest. I
Therefore, the City of Arlington has requested that the City of Fort Worth enter into an
Interlocal Contract, with the following provisions:
Worth The City of Fort rt th has no objection to the condemnation of real property
located within Fort Worth city limits by the City of Arlington for the sole purpose
of constructing a sports complex;
The City of Arlington is the condemning authority and will be responsible for all
costs associated with the eminent domain proceedings.
The Conti-act is not an agreement to adjust boundaries or exchange jurisdiction but
only an agreement to allow condemnation by the city of Arlington for the sole
purpose of constructing a sports complex.

The plans and any information associated with condemnation action and
construction of the facility will be provided to Fort Worth if requested;
Arlington recognizes and acknowledges that the adjacent land to the north of the
property Complex is Fort Worth's backup facility for sludge drying beds at Village
Creek Wastewater Treatment Plan. Arlington agrees that construction and use of
the Sports Complex shall not interfere with operation, maintenance, repair and
expansion of the Village Creek Treatment Facility.

Real Property Management requested that the Water Department conduct a review of
Arlington's request to ensure the City's needs are protected as it relates to the operation and
future expansion of the Village Creek Wastewater Treatment Facility. The Water Department
has determined that the proposed interlocal agreement will not interfere with any future
development plans at the Village Creek facility.
The Parks and Community Set-vice Department has also reviewed the request and concurs that
additional sports facilities, which are planned to include 6 new soccer fields and 4 football
fields, are a positive asset. Upon completion the facilities will be available and accessible to
Fort Worth residents.
The Planning Department has determined that the subject property is designated as floodplain
in the proposed 2000 Comprehensive Plan. The proposed recreational use of the property
?"41iowever is compatible with that designation and would not require a change in the proposed
land use plan.
