SUBJECT: Transfer of FBO at Spinks Airport
On October 10, 2000 the City Council approved M&C L-12932 for the transfer of Fixed Based Operator
(FBO) services at Spinks Airport. Superior Aircraft Management, Inc., proposed to assume FBO
responsibilities including aircraft fueling and tugging services, as well as the sale of aviation-related projects
such as charts and oil. Superior was to take over FBO duties on January 1, 2001. On December 29, 2000,
Truitt Clinard, president of Super-ior Management, advised staff that they would not sign the lease agreements
and would not be able to assume the FBO. They sited their inability to move their operation from Arlington
as quickly as they had thought and they did not think that they would be able to operate both businesses
Fortunately, in preparation for the transition of the FBO there were only two, employees affected by the
change. One employee transferred to Meacham into a vacant position. The other employee is still employed
at Spinks as an aircraft fueler. Other positions that were to be affected are filled with temporary employees.
m,, he negotiations for this action were protracted and a great deal of staff time was spent drafting and
reviewing lease agreements. Because of this, staff will recommend to the City Council the adoption of a
Property Lease Application Fee to be implemented at the City's Airports. The fee will be equal to the first
month's rent for the property and will be due at the point that the prospective tenant wishes to have the lease
documents drafted. If negotiations fail by mutual agreement, the fee will be refunded. If, however, the
prospective tenant unilaterally pulls out after the fee is paid, the fee will be forfeited. No interest will be paid
on the amount. If the lease agreements are signed and fully executed, the payment will be applied to the first
month's rent.
An M&C will be placed on the Council agenda in the near future asking for approval of this fee.
