AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE NEW EQUIPMENT PURCHASE FUND IN THE
AMOUNT OF $138,371.00 TO BE OBTAINED THROUGH THE CITY'S
EQUIPMENT NOTE PROGRAM APPROVED ON FEBRUARY 9, 1999, (M&C G-
12462) BY ORDINANCE NO. 13701 FOR THE PURPOSE OF FUNDING A FIRE
REHABILITATION TRUCK FROM FORT WORTH FREIGHTLINER FOR THE
FIRE DEPARTMENT; PROVIDING A SEVERABILITY CLAUSE MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL
PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2002-
2003 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the New Equipment Purchase Fund in the amount of $138,371.00 to be obtained
through the City's Equipment Note Program approved on February 9, 1999, (M&C G-12462) by
Ordinance No. 13701 for the purpose of funding a fire rehabilitation truck from Fort Worth
Freightliner.
SECTION 2.
That should any portion, section or part of a section of this severability clause be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3:
That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the. purchase of a new fire rehab truck from Fort Worth Freightliner for 'the Fire
Department at a cost not to exceed $138,371 with payment due within 10 days of the date of the
invoice and freight is included in the unit price; and'
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
New Equipment Purchase Fund by $138,371, to be obtained through the City's Equipment Note
Program approved on February 9, 1999 (M&C G-12462), Ordinance No. 13701.
DISCUSSION:
This rebid was authorized by the City Council on January 14, 2003 (M&C P-9736), because the original
bid No. 02-0264 received only one bid that did not meet the specifications requiring vendors to meet the
Texas Motor Vehicle Code, Section 5.04. The Texas Motor Vehicle Code requires a vehicle conversion
company to sell new converted vehicles through a licensed franchised dealership for the underlying cab
and chassis. ~ .
This truck is a replacement for the City's uneconomically repairable unit No. 225-0008 that will be sold
at auction, and was part of the FY2002-2003 adopted budget that approved the replacement equipment
as part of the new equipment replacement plan. Firefighters will use this truck for response to
emergency incidents where.firefighfers or citizens of .Fort Worth need to be sheltered from inclement
weather or rehabilitated with fluids, rest, and medical treatment.
Upon the review of both bids received, the large disparity between the lovv bid and the high bid was
determined to be the following: SVI Trucks Fire and Rescue, located out of state in Loveland, Colorado,
quoted a chassis that exceeds the minimum specifications and must be obtained from Spartan Motors.
Fort Worth Freightliner, located within 'the City of Fort Worth, quoted a less expensive Freightliner
chassis that meets the minimum specifications and will be obtained from Freightliner's own chassis
manufacturing plant.
BID ADVERTISEMENT -This bid was advertised in the Commercial. Recorder on January 22 and 29,
2003. The Purchasing Division solicited 15 vendors from the purchasing system database and 20 from
the DemandStar.com plan holders. Two vendors responded with a bid:

~MNVBE - A waiver of the goal for M/WBE subcontracting requirements was requested by the
Purchasing Division and approved by the M/WBE Office because the .purchase of goods is from
sources where subcontracting or supplier opportunities are negligible.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds for. this purchase will be obtained through the City's Equipment
Note Program.
