HomeMy WebLinkAboutIR 8363 INFORMAL REPORT TO CITY COUNCIL MEMBERS No. $363 December 4, 2001 To the Mayor and Members of the City Council rera SUBJECT: Agreements with Counties on Subdivision Approvals in Fort Worth's Extraterritorial Jurisdiction (House Bill 1445) In an effort to address the Mayor & City Council's Strategic Goal to "promote orderly growth in developing areas" and compliance with House Bill 1445, agreements with counties regarding subdivision approvals in the City's extraterritorial jurisdiction (ETJ) need to be negotiated. House Bill 1445 passed the 77th Legislative Session, which became law on September 1, 2001 and requires cities and counties to approve agreements by April 1, 2002. The purpose of the bill is to unify the subdivision approval process into one entity in a municipality's ETJ. The bill provides four options for compliance: 1. Interlocal Agreement granting exclusive approval to municipality; 2. Interlocal Agreement granting exclusive approval to County; 3. Interlocal Agreement granting exclusive approval within defined geographic area to each mot, entity; or 4. Creation of a new office with sole approval. Staff proposes to negotiate Interlocal Agreements with all five counties (Denton, Johnson, Parker, Wise and Tarrant) in which Fort Worth has ETJ for exclusive approval by municipality. It is desirable that these agreements will include concurrent approval of the infrastructure construction standards (currently utilized by Tarrant County). Attached is a map depicting the City of Fort Worth, its ETJ and adjoining counties. Unless staff receives alternative direction from the City Council, negotiations with adjoining counties will begin. The staff position will be -- exclusive approvals of subdivisions in the City's ETJ will be the responsibility of the City of Fort Worth. Staff will provide interim reports on the progress of these negotiations before Interlocal Agreements are developed for City Council consideration.
