Present: Mayor Betsy Price Mayor Pro tem W.B. "Zim" Zimmerman, District 3 —left at 9:49 am Council Member Salvador Espino, District 2 Council Member Daniel Scarth, District 4 Council Member Gyna Bivens, District 5 Council Member Jungus Jordan, District 6 Council Member Dennis Shingleton, District 7 Council Member Kelly Allen Gray, District 8 Council Member Joel Bums, District 9—out 9:29am—9:35am Staff Present: Tom Higgins, City Manager Sarah Fullenwider, City Attorney Mary J. Kayser, City Secretary Fernando Costa, Assistant City Manager Susan Alanis, Assistant City Manager Charles Daniels, Assistant City Manager Gerald Pruitt, Deputy City Attorney Peter Vaky, Deputy City Attorney Chris Mosley, Sr. Assistant City Attorney Chris Trout, Sr. Assistant City Attorney Doug Black, Assistant City Attorney Jean Petr, Gas Well Leas Manager Randle Harwood, Planning and Development Director Terry Holderman, Assistant City Auditor Police Chief Jeff Halstead Jo Ann Rowls, Senior Risk Management Analyst Ralph Duggins, Attorney— 9:35am—9:39 am With a quorum of the City Council Members present, the Fort Worth City Council convened into closed Executive Session at 9:21 a.m. on Monday, October 7, 2013, in the Pre-Council Chamber of the Fort Worth Municipal Building to discuss matters pertaining to the following: 1. Seek the advice of its attorneys concerning the following pending or contemplated litigation or other matters that are exempt from public disclosure under Article X, Section 9 of the Texas State Bar Rules and as authorized by Section 551.071 of the Texas Government Code: CITY OF FORT WORTH, TEXAS SPECIAL CITY COUNCIL MEETING OCTOBER 7, 2013 PAGE 2 of 2 a. Harmit Chattha v. City of Fort Worth, Civil Action No. 4:13-CV-055-Y, United States District Court for the Northern District of Texas, Fort Worth Division; b. Legal issues related to Meet and Confer Labor Agreement; c. Legal issues related to Motor Vehicle Accident Tolling Agreement with Tarrant County; d. Legal issues related to subrogation claims involving Keith Key; e. Legal issues related to City's mineral leases; f. Legal issues related to filing an Amicus brief in the case of Zachry Construction Corporation vs. Port of Houston Authority of Harris County, Texas, No. 12-0772 in the Texas Supreme Court; and g. Legal issues concerning any item listed on today's City Council meeting agendas; 2. Deliberate the purchase, sale, lease or value of real property in accordance with Section 551.072 of the Texas Government Code. Deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third party; and 3. Deliberate concerning economic development negotiations as authorized by Section 551.087 of the Texas Government Code; and 4. Deliberate the deployment, or specific occasions for implementation, of security personnel or devices, in accordance with Section 551.076 of the Texas Government Code. There was no formal action taken by the City Council on the items discussed during the Executive Session and with no further business to be conducted, Mayor Price adjourned the meeting at 9:55 a.m. on Monday, October 7, 2013.
