AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF A
TEN FOOT WIDE ALLEY, SITUATED BETWEEN LOT 3, LOT 4, LOT 5,
AND LOT 6, BLOCK M OF THE BELLEVIE HILL ADDITION, AN
ADDITION TO THE CITY OF FORT WORTH, TEXAS, AS RECORDED
IN VOLUME 106, PAGE 39 OF THE PLAT RECORDS OF TARRANT
COUNTY, TEXAS; CONTAINING APPROXIMATELY 1,000 SQUARE
FEET OF LAND OR 0.0230 ACRE OF LAND, PROVIDING FOR
REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY
SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
SECTION 1.
That a portion of a ten foot alley, situated between Lot 3, Lot 4, Lot 5, and Lot 6 of Block
M, of the Bellevue Hill Addition, an addition to the City of Fort Worth, as recorded in Volume
106, Page 39 of the Plat Records of Tarrant County, Texas, and containing approximately 1,000
square feet or 0.0230 acre of land more or less, and as more specifically described in Exhibits
"A" and "B" attached hereto and incorporated herein by reference be and the same is vacated
and extinguished.
SECTION 2.
That the right of way easement to the land in the above-described vacated street right of
way is hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easements be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

Being a description of an alley vacation or closure situated between Lot
3, Lot 4, Lot 5, and Lot 6, Block M, of the Bellevue Hill Addition to the
City of Fort Worth, Tarrant County, Texas recorded in Volume 106, Page
39, Plat Records, Tarrant County, Texas and being more particularly
described by metes and bounds as follows:
BEGINNING at a point at the southwest corner of Lot 4, Block M, Bellevue
Hill Addition, conveyed to Tarrant Properties, Inc. by Instrument No.
D212157096, Deed Records, Tarrant County, Texas, (D.R.T.C.T. ) , in the
north right-of-way line of West Baltimore Avenue, (50' right-of-way) , and
being the southeast corner and point of beginning of the herein described
tract of land;
THENCE, WEST, with the south line of said, alley and the north right-of-
way line of West Baltimore Avenue, 10.00 feet to a point at the southeast
corner of Lot 5, Block M, Bellevue Hill Addition, as conveyed to Saul
Lopez Delgadillo by Instrument No. D197017955, (D.R.T.C.T. ) ;
THENCE, NORTH, with the east line of said, Lot 5, Block M, at 50.00 feet

SUBJECT:
Adopt Ordinance Vacating a Portion of an Alley Between Richmond Avenue and Baltimore Avenue for New
Single Family Residential Construction (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of an alley between Richmond Avenue and
Baltimore Avenue for a new single family residential construction; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy
(Mayor and Council Communication G-15624).
DISCUSSION:
Dean Surveyors, on behalf of Tarrant Properties Inc., has requested the vacation of this portion of the
alley to replat it with the adjoining property for new single family home construction. The City Plan
Commission recommended approval of this request at its meeting on April 24, 2013. An acceptable final
plat(FS-013-030) has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth (City)originally obtained the above mention right-of-way through the platting
process. The City does not own any fee interest in the rights-of-way or owns any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easements for the streets and alley.
This project is located in COUNCIL DISTRICT 9, Mapsco 76R.
