SUBJECT: Status of Neighborhood and Community Park Dedication
Policy
This report is presented in response to the June 4, 2003 request by City Council for an update on the status
of the new Neighborhood and Community Park Dedication Policy.
On December 26, 2000 the current Neighborhood and Community Park Dedication Policy came into
effect. This policy governs parkland dedication and neighborhood park facility development
requirements related to residential development. When new residential development occurs in an area,
and existing population density is increased as a result, parkland dedication (land or fees-in-lieu thereof)
and facility development fees are required of the developer.
To date the current park policy has been very successful, generating the potential for 42 new developed
park sites, Citywide, as indicated on approved preliminary plats. Each of these sites will either be: 1)
developed by the City when subdivision development is complete and all facility development fees are
paid, or 2) the developers will offset their cash fees due by constructing the park facility development
prior to dedication. There are currently 23 parks final platted. To date, 16 developers have fonnally
agreed to construct park facilities prior to dedication. Park sites are not always dedicated in the first phase
of subdivision development and the decision to offset fees by park construction does not need to be made
by the developer until the first subdivision final plat is ready to be filed at the courthouse. The parkland
and any facilities constructed must be inspected for suitability and adherence to park facility construction
guidelines prior to City acceptance. Attached are some examples of recent park development, paid for by
developers, that has occurred as a direct result of the success of the park dedication policy.
Staff is actively seeking land acquisition opportunities as funds become available in underserved
neighborhood and community park units and the policy has been successful in generating fees for
community parkland acquisition. In February 2003, fees were used to acquire the cornerstone of a
potential I I I acre parkland assemblage located in the Trinity River Corridor. The initial land acquisition
of a 26.5 acre community park site adjoins a 7.0 acre required neighborhood park dedication which will
serve the residents of Mallard Cove Estates and East Fort Worth. In July 2003, an additional 8.0 acres of
community parkland was acquired, which brings the current parkland assemblage of Mallard Cove Park
to 41.5 acres.
The Development Standards Task Force has identified park dedication policy implementation concerns
related to the unique challenges of Central City redevelopment projects. Staff worked with the Task
Force to determine policy refinements such that policy implementation in the Central City will be more
sensitive to redevelopment concerns, but continue to provide sufficient resources for land acquisition and
park facility development. Staff will bring all of the Task Force's recommendations forward for City
Council action this Fall.
One positive effect of the policy is that no new reserve park sites are being generated and the park needs
of residents are being met when they move into new neighborhoods. It is staff's opinion that the new
