Ta To the Mayor and Members of the City Council April 6, 2004
• SUBJECT: Deacon Chadwick's request for Curb and Gutter on
Carver Street (citizen presentation made on 3/30104)
1. Carver Street is an asphalt street with no curb and gutter. Specifically,Deacon Chadwick wants the City to build
curb and gutter along the church's property so they could build a concrete parking lot for the church on the
existing dirt parking lot.
❑ Staff explained to Deacon Chadwick, last year,that in order to reconstruct the street with curb and gutter, it must
compete with other streets in the city in the Bond election. He was told about the process and advised that he
should attend the Bond Program public meetings to let his Council member know of his concerns. He was not
specifically contacted about when the public meetings were to be held,
❑ The street does not rank high on the Neighborhood Street reconstruction list and therefore was not included in the
Bond Program. Mote: About 15%of the street network does not have curb and gutter.
❑ Since this street isn't in the Bond Program,the Transportation and Publics Works Department has no other
identified ftmding source to install curb and gutter. Deacon Chadwick was told that during the last meeting with
Marc Ott,Robert Goode,and George Behmanesh.
❑ During that same meeting,Deacon Chadwick was told that the City has other sources of funds that may be
applicable. Staff in that meeting were not experts in those funding sources, so Deacon Chadwick was advised to
contact Ms.Emerson directly to see if she knew of any other sources that could be used for this project.
❑ Ms. Emerson told Mr. Chadwick that unless the curb and gutter was associated with another project that was
receiving grant money and/or a funding request was made from TPW for the installation of curbs and gutters at the
church,that she could not make the decision to direct money for this use. Mote: TPW requests funds, infrequently,
for assistance with Neighborhood Street projects.
❑ Even without curb and gutter,the church could still build a parking lot. Deacon Chadwick thinks that the only way
he could build a parking lot is to have curb bordering the lot Staff has explained to him that he could build his
parking lot without curb and gutter on the street. In fact,the City would not allow the parking lot to be built into
the road's right-of-way in order to butt up against the roadway's curb.
❑ Staff offered several times to overlay the meet since it does need rehabilitation. However,Deacon Chadwick has
refused that option thinking that he would"never get curb and gutter" if that happens.
2. Currently,homes are being built on Carver Street on lots that were previously platted. Why is the City not requiring the
builder to construct curb and gutter?
❑ The developer is budding houses on previously platted lots. Thus,the subdivision ordinance does not require the
developer to construct curb, gutter,and sidewalk for this development
NOTE: This issue is similar to the recent Council Proposal(authored by CM Haskin and CM Moss)on Milam Street
with the exception of the platting issue. In that case, the lots were being re platted and therefore the developer was
required to build curb,gutter, and sidewalks along a street that currently had no infrastructure in place (like this case).
However, the Council supported the CPs recommendation that the City waive the requirement that the developer
build curb,gutter, and sidewalk since the rest of the street won't have this infrastructure built in the near future.
As you know, there are 728 lane miles of streets rated"poor"in our network. Unfortunately, we do not have enough funds
dedicated in the Bond Program to repair all those streets,let alone build curb and gutter throughout the entire street network
Staff has worked with Deacon Chadwick from our first contact to our last meeting in an attempt to find a way to fund this
project. Staff has strived to think outside the box(while NEVER committing to Deacon Chadwick that the City would fund,
and build,curb and gutter along the church's frontage). Regrettably, staff has found no way to fund construction of curb
and gutter on Carver Street. As mentioned above, this in no way precludes the church from building their parking lot if they
so choose.
