HomeMy WebLinkAboutOrdinance 15547Ordinance No. ~J~ / AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $35,462.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE SAFE AND SOBER SELECTIVE TRAFFIC ENFORCEMENT PROGRAM (STEP); MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2002-2003 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $35,462.00, from available funds, for the purpose of funding the Safe and Sober Selective Traffic Enforcement Program (STEP). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager to execute a contract amendment with the Texas Department of Transportation (TxDOT) decreasing the amount received from TxDOT on the Safe and Sober Selective Trafi:tc Enforcement Program (STEP) program by $52,140; and 2. Authorize the use of $35,462 in inkind indirect costs a.s a matching amount for this grant; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $35,462. DISCUSSION: On October 1, 2002 ~(M&C C-19274), the City Council authorized the City Manager to execute a contract with TxDOT to continue the operation of the Comprehensive: STEP. TxDOT has now requested a contract amendment that will bring both TxDOT and the City into full compliance, with Federal Grant Regulations. The amendment will: •. Change the name of this project from Comprehensive STEP to Safe and Sober STEP, which appears on the Texas Highway Safety Plan's approved project list; and • Correct the City's required match from 25% to 50%; and • Authorize the use of indirect costs as an inkind match for this grant. When the original contract was prepared, the state requested a 25% match. However, federal regulations require a 50% match. Necessary .budget and programmatic changes have been made in order to .ensure that the City meets the 50% match requirement without exceeding the $75,460 in matching funds that, were approved by the City Council on October 1, 2002. This revision also increases the total project amount from $214,000 to $218,349. The indirect cost was initially waived on M&C C-19274, but TxDOT has authorized its use as an inkind match for this amendment.
