AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANT FUND BY $2,000,000.00, FOR THE
CONSTRUCTION OF PARK IMPROVEMENTS IN THE MARINE CREEK PARK
CORRIDOR (BUCK SANSOM PAW MARINE CREEK LINEAR PARK NORTH,
MARINE CREEK LINEAR PAW LINCOLN PARK AND RODEO PARK)-
PROVIDING FOR A SEVERABILrry CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN
CONFLICT fIEREWTTH; AND PROVIDING AN EFFECTIVE DATE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the
Budget of the City Manager, there shall also be an increase in the estimated receipts and appropriations in
the Grant Fund by $2,000,000.00, for the Construction of Park Improvements in the Marine Creek Park
Corridor (Buck Sansom Park, Marine Creek Linear Park North, Marine Creek Linear Park, Lincoln Park
and Rodeo Park).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Provide for Staff Costs and Contingency for a Total Construction Phase Project Amount of$2,897,902.23
and Adopt Appropriation Ordinance (COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the acceptance of a monetary donation in the amount of $10,000.00 from Streams and
Valleys, Inc., for improvements in the Marine Creek Park Corridor;
2. Authorize the transfer in the amount of$990,000.00 from the Park Gas Lease Project Fund to the
Grant Fund towards the City's match;
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grant Fund in the amount of$2,000,000.00; and
4. Authorize the execution of a construction contract with Cole Construction, Inc., in the amount of
$2,384,865.10 for the construction of park improvements in the Marine Creek Park Corridor (Buck
Sansom Park, Marine Creek Linear Park North, Marine Creek Linear Park, Lincoln Park and Rodeo Park).
DISCUSSION:
The purpose of this Mayor and Council Communication (IVI&C) is to authorize the acceptance of a
monetary donation in the amount of$10,000.00 from Streams and Valleys, Inc., for park improvements in
the Marine Creek Park Corridor project, and award of a construction contract to Cole Construction, Inc., in
the amount of$2,384,865.10 for the construction of park improvements in the Marine Creek Park Corridor
(Buck Sansom Park, Marine Creek Linear Park North, Marine Creek Linear Park, Lincoln Park and Rodeo
Park).
Project funds include 2004 CIP, 2013 Certificates of Obligation (CO), gas revenues and a donation from
Streams and Valleys, Inc., together totaling $2,389,918.23, which are to be allocated as leverage funds
with a $1,000,000.00 Texas Parks and Wildlife Grant for a total project budget in the amount of
$3,389,918.23.
On February 9, 2010, (M&C G-16845) the City Council authorized the application for a Texas Parks and

Wildlife Department (TPWD) Urban Outdoor Recreation Grant with award of grant funding from TPWD
received on August 26, 2010.

On April 12, 2011, the City Council authorized execution of a Professional Services Agreement with Halff
Associates, Inc., (M&C C-24862) in the amount of$338,966.00 for the design and engineering of park
improvements in the Marine Creek Park Corridor. Subsequent contract amendments for additional
engineering and design services brought the total amount to $419,516.00. In addition, the amount of
$72,500.00 has been expended on design phase administration for a total cost of$492,016.00.
The project advertised on June 6, 2013 and June 13, 2013, in the Fort Worth Star-Telegram and on July
11, 2013 the following bids were received and tabulated as follows:

BASE BID - Improvements include site preparation and demolition, trails, a pedestrian bridge, new low
water crossing, parking lot improvements, picnic pavilion, and playground replacement. It is recommended
that the base bid amount totaling $2,207,367.10, Unit 7 Alternates (Line Items 1-3, 5 and 7) totaling
$18,298.00, Unit 8 Alternates totaling $69,200.00, and Unit 10 Alternates totaling $90,000.00 as submitted
by Cole Construction, Inc., resulting in a total contract bid amount of$2,384,865.10 be authorized for
award of contract to Cole Construction, Inc. Contract time is 275 calendar days. In addition to the contract
cost, associated contingency funding for project administration, construction inspection, materials testing
and change orders is estimated in the amount of$513,037.13 for a construction phase total of
$2,897,902.23.
M/WBE Office - Cole Construction, Inc., is in compliance with the City's BIDE Ordinance by committing to
21 percent MBE participation on this project. The City's MBE goal on this project is 15 percent.
Permitting fees shall be waived for this project as noted in the contract specifications, Division I - General
Requirements - Section 01100 - Summary of Work - Note. No. 3.
The estimated impact on the annual operating budget will be in the amount of$3,500.00 due to additional
maintenance in areas where new trails will be constructed.
Construction is anticipated to commence in October 2013 and be completed by June 2014.
The Marine Creek Park Corridor is located in COUNCIL DISTRICT 2, Mapsco 48W, 62A, 62B and 62F.
FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations
and adoption of the attached appropriation ordinance, funds will be available in the current capital budget,
as appropriated, in the Grants Fund, the Street Improvements Fund, Park Gas Well Leases Fund and the
Park Improvements Fund.
