HomeMy WebLinkAboutOrdinance 20996-10-2013 Ordinance No. 20996-10-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORMWATER UTILITY FUND IN THE AMOUNT OF $185,000.00, DECREASING THE AVAILABLE CASH BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF EXECUTING A PROFESSIONAL SERVICES AGREEMENT WITH HALFF ASSOCIATES, INC., TO MANAGE THE CITY'S DRAINAGE DESIGN REVIEW PROCESS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Stormwater Utility Fund in the amount of$185,000.00, decreasing the available cash balance by the same amount, for the purpose of executing a professional services agreement with Halff Associates, Inc., to manage the City's drainage design review process. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent Jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in ftilt force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the execution of a Professional Services Agreement with Halff Associates, Inc., in an amount not to exceed $185,000.00 for services to manage the City's drainage design review process; and 2. Adopt the attached supplemental appropriation ordinance increasing the estimated receipts and appropriations in the Stormwater Utility Fund in the amount of$185,000.00 decreasing the available cash balance by the same amount. DISCUSSION: The purpose of this Agreement is to expedite the review of new development projects for compliance with City drainage standards. One of the primary recommendations from a recent initiative to improve the City's drainage standards and review process was the establishment of a senior engineer position to manage the design review process. This Agreement will provide these management services via a consultant employee until the permanent Staff position is filled which is projected to occur in January, 2014. Additional capacity is provided in the Agreement to cover a longer recruitment period. In 2011, the Transportation and Public Works Department, Stormwater Management Division published a Request for Qualifications (RFQ)for various technical services associated with drainage engineering, including services to review private development projects for compliance with the City's drainage design standards. Halff Associates, Inc. (HAI), was selected as the most qualified engineering consultant for this service. HAI has been providing drainage design review services for the City for over one year and has the most qualified employee for providing the management services. Halff Associates, Inc., proposes to perform this work on an on-call, time and materials basis for a fee not to exceed $185,000.00.
