AUTHORIZING THE EXECUTION OF AN INTERLOCAL AGREEMENT
WITH THE TEXAS DEPARTMENT OF MOTOR VEHICLES TO FLAG
REGISTRATIONS OF VEHICLES WHOSE OWNERS ARE ALLEGED TO BE
DELINQUENT IN THE PAYMENT OF CIVIL PENALTIES IMPOSED BY
THE CITY'S AUTOMATED REDLIGHT ENFORCEMENT PROGRAM
WHEREAS, Texas Transportation Code §707.017 provides that if the owner of a motor vehicle is
delinquent in the payment of a civil penalty imposed by a photographic traffic signal enforcement system,
the County Tax Assessor-Collector or the Texas Department of Motor Vehicles may refuse to register a
motor vehicle alleged to have been involved in the violation: and
WHEREAS, pursuant to Texas Transportation Code §707.002, the City Council adopted Ordinance
No. 17677 establishing the Automated Red Light Enforcement Program for the City of Fort Worth: and
WHEREAS, the City of Fort Worth desires to enter into an Interlocal Agreement with the Texas
Department of Motor Vehicles (TxDMV) under which TxDN/lV will flag registration renewals of a motor
vehicle whose owner, as indicated by information submitted to it by the City, is alleged to be delinquent in
the payment of a civil penalty for said vehicle's violation of the City's Automated Red Light Enforcement
Program;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
The City Manager is authorized to execute an Interlocal Agreement with the Texas Department of
Motor Vehicles to flag registration renewals of a motor vehicle whose owner, as indicated by information
submitted to it by the City, is alleged to be delinquent in the payment of a civil penalty for said vehicle's
violation of the City's Automated Red Light Enforcement Program.

Adopt Resolution Authorizing an Interlocal Agreement with the Texas Department of Motor Vehicles to Flag
Vehicle Registrations of Motor Vehicle Owners who are Delinquent in the Payment of a Civil Penalty and
Whose Vehicle is Alleged to Have Been Involved in a Violation of the Automated Red Light Enforcement
Program (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council adopt the attached resolution authorizing the City of Fort Worth to
enter into an Interlocal Agreement with the Texas Department of Motor Vehicles to flag vehicle
registrations of vehicle owners who are delinquent in the payment of a civil penalty and whose vehicle is
alleged to have been involved in a violation of the Automated Red Light Enforcement Program.
DISCUSSION:
Section 707.017(a) of the Texas Transportation Code currently provides that if the owner of a motor
vehicle is delinquent in the payment of a civil penalty imposed under this chapter, the County Tax
Assessor-Collector or the Texas Department of Motor Vehicles may refuse to register a motor vehicle
alleged to have been involved in the violation. An Interlocal Agreement (Agreement) with the Texas
Department of Transportation (TxDOT)was approved on May 5, 2009 (M&C C-23501) to flag motor
vehicle registrations of vehicle owners delinquent in paying red-light camera violations. However, TxDOT
was reorganized and the Texas Department of Motor Vehicles (TxDMV) was established as a separate
organization. Because of this action by the State, an Agreement with the TxDMV is now necessary.
Adoption of the attached resolution authorizes the City to enter into an Agreement with the TxDMV to flag
motor vehicle records. The Agreement also provides for the establishment of an escrow account to fund
the costs of placing holds on registrations. Monthly costs are $23.00 per computer run and $.12 per file
transaction. The Red Light Enforcement Fund annually budgets $6,000.00 to deposit into the escrow
account as part of the program expenses and, as part of the Agreement, a minimum balance of$500.00
must be maintained. Only violations that are 90-days past due are submitted to the State for registration
holds. Upon adoption of the resolution, the City will deposit $6,000.00 in the State's escrow account and
draw against it for motor vehicle registration holds for Fiscal Year 2014.
FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendation,
funds are available in the Red Light Enforcement Fund, as budgeted.
