AN ORDINANCE VACATING AND EXTINGUISHING SEMINARY STREET BETWEEN JAMES AVENUE AND SIXTH AVENUE, BROADUS AVENUE BETWEEN JAMES AVENUE AND SIXTH AVENUE, A PORTION OF HUBBARD AVENUE BETWEEN SEMINARY STREET AND SIXTH AVENUE; WASHINGTON AVENUE BETWEEN SEMINARY STREET AND WEST BEDDELL STREET; TWO ALLEYS LOCATED IN BLOCKS 4 5, AND 6, ALL IN HUBBARD HIGHLANDS ADDITION, FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following streets and alleys described below: 1. Seminary Street, a 40-foot wide by 1412-foot long right-of--way lying between James Avenue on the west and Sixth Avenue on the east, lying between that certain tract of land in the William W. Wheat Survey, Abstract No. 1645, and as recorded in Volume 1290, Page 231 of the Deed Records of Tarrant County, Texas, and Blocks 1, 2 and 3, Hubbard Highlands, as recorded in Volume 388, Page 32, Tarrant County Plat Records, and containing 1.2966 acres of land; 2. Broadus Avenue, a 60-foot wide by 1414-foot long right-of-way, lying between James Avenue on the West and Sixth Avenue on the East and between Blocks 1, 2 and 3 on the north, and Blocks 4, 5 and 6 on the south, Hubbard Highlands, and as recorded in Volume 388, Page 32, Tarrant County Plat Records, and containing 1.9477 acres of land; 3. Washington Avenue, a 60-foot wide by 39$-foot long right-of-way lying between Seminary Street and West Beddell Street and Blocks 2, 3, 4 and 5, Hubbard Highlands, as recorded in Volume 388,' Page 32, Tarrant County Plat Records, and containing 0.5482 acres of land; 4. Hubbard Avenue, a 60-foot wide by 362-foot long right-of--way between Seminary Street and Sixth Avenue, Hubbard Highlands, as recorded in Volume 388, Page 32, Tarrant County Plat Records, and containing 1.9477 acres of land; 5. Two alleys, one alley being 12 feet wide north and south 295 feet long; the second alley being 15 foot wide east and west 1050 feet long, in Blocks 4 and 5, Hubbard Highlands; and a certain part of the same alley being 15 feet wide and 46 feet long in Block 6, Hubbard Highlands Addition, lying between Hubbard Avenue and Sixth Avenue. and as more specifically described in Exhibit "A", attached hereto and incorporated herein, by reference be and the same are vacated and extinguished: SECTION 2. That the fee to the land in the above-described vacated street portions and alleys is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect upon adoption. The above property contains approximately 5.0 acres of land:. DISCUSSION: Fort Worth Independent School District, owner of the above-described properties, has requested vacation of the above referenced streets and alleys to replat with adjoining property. Surface improvements include a Masonary School Building and detached gymnasium. Underground improvements include sewer and storm drainage. Said streets and alleys shall be retained as utility easement for existing utilities. The City Plan Commission recommended approval at its Public Hearing on February 27, 2002. The Engineering Department, Real Property Services Division states that a fee of $1.00 will satisfy the public interest. Reviewing City departments and public utility companies have raised no objections to this request. An acceptable replat has been provided (FS-002-016).
