Home My WebLink AboutContract 59546-A1CSC No. 59546-Al AMENDMENT NO. 1 TO CITY SECRETARY CONTRACT NO. 59546 COOPERATIVE PURCHASE AGREEMENT This First Amendment to Fort Worth City Secretary Contract No. 59546 ("Agreement") is made between the City of Fort Worth ("City"), a Texas home -rule municipal corporation through its duly authorized Assistant City Manager, and Williams Scotsman, Inc. (hereafter "Vendor"). City and Vendor are each individually referred to herein as a "Party" and collectively as the "Parties." WHEREAS, the Parties have previously entered into City of Fort Worth City Secretary Contract No. 59546 for a term that began on June 7, 2023 which renews automatically under the same terms and conditions for up to three (3) one-year renewal periods; and WHEREAS, the Parties wish to amend the Agreement to add XSale 20' Containers, a service within Cooperative Agency Contract Omnia # R210503; WHEREAS, the Parties wish to amend the Agreement to increase the present and future annual amount by $50,000 for additional services so that total annual payment made under this Agreement by City shall not exceed $100,000.00. NOW, THEREFORE, City and Vendor, acting herein by the through their duly authorized representatives, enter into the following agreement to amend the Agreement: 1. AMENDMENTS TO CONTRACT 1. The Compensation section of the Agreement is hereby replaced in its entirety with the following: City shall pay Vendor in accordance with the fee schedule in Exhibit A and in accordance with the provisions of this Agreement. Total payment made under this Agreement by City shall not exceed One Hundred thousand dollars and no cents ($100,000.00). Vendor shall not provide any additional items or services or bill for expenses incurred for City not specified by this Agreement unless City requests and approves in writing the additional costs for such services. City shall not be liable for any additional expenses of Vendor not specified by this Agreement unless City first approves such expenses in writing. 2. WORTH, TX 2. ALL OTHER TERMS SHALL REMAIN THE SAME All other provisions of the Contract which are not expressly amended herein will remain in full force and effect. 3. A facsimile copy or computer image, such as a PDF or tiff image, or a signature, shall be treated as and shall have the same effect as an original.
