HomeMy WebLinkAboutOrdinance 27739-06-2025Ordinance No. 27739-06-2025 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER & SEWER BOND 2017A FUND, BY DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE UNSPECIFIED ALL -FUNDS PROJECT (CITY PROJECT NO. UNSPEC) IN THE AMOUNT OF $570,000.00 AND INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE MARY'S CREEK WATER RECLAMATION FACILITY PROJECT (CITY PROJECT NO. C01239) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2024-2025, as enacted by Ordinance 27107-09- 2024, as amended, is hereby further amended to make the following adjustments to estimated receipts and appropriations in the Water & Sewer Bond 2017A Fund, by decreasing estimated receipts and appropriations in the Unspecified All -Funds project (City Project No. UNSPEC) in the amount of $570,000.00 and increasing estimated receipts and appropriations in the Mary's Creek Water Reclamation Facility project (City Project No. C01239) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Y CAM P,B�OWIE WEST_ BLVDrr FORT WORTH City of Fort Worth, Texas Mayor and Council Communication DATE: 06/10/25 M&C FILE NUMBER: M&C 25-0535 LOG NAME: 60MARY'S CREEK WRFPECD-FUNDING SUBJECT (CD 3 and ETJ) Adopt Appropriation Ordinance in the Amount of $570,000.00 for Additional Project Costs for Final Design of the Mary's Creek Water Reclamation Facility to Effect a Portion of Water's Contribution to the Fiscal Years 2025-2029 Capital Improvement Program RECOMMENDATION: It is recommended that the City Council adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Water & Sewer Bond 2017A Fund by increasing estimated receipts and appropriations in the Mary's Creek Water Reclamation Facility project (City Project No. C01239) in the amount of $570,000.00 and decreasing estimated receipts and appropriations in the Unspecified All -Funds project (City Project No. UNSPEC) by the same amount, to effect a portion of Water's contribution to the Fiscal Years 2025-2029 Capital Improvement Program. DISCUSSION: On November 8, 2022 the City Council authorized execution of an agreement with Plummer Associates, Inc. in the amount of $1,773,698.00 to conduct process evaluation and concept design for the Mary's Creek Water Reclamation Facility (MCWRF) Mayor & Council Communication (M&C) 22-0892 (CSC No. 58487). The agreement was subsequently revised by Amendment No.1 in the amount of $5,057,498.00 authorized by City Council on September, 26, 2023 (M&C 23-0828; CSC No. 58487-A1) to conduct preliminary design for the Mary's Creek Water Reclamation Facility and Amendment No. 2, in the amount of $14,666,092.00 authorized by City Council On October 15, 2024 (M&C 24-0858; CSC No. 58487-A2), to conduct final design of Mary's Creek Water Reclamation Facility. Additional funding in the amount of $570,000.00 is necessary to provide increased project costs to provide for pre -selection of suppliers of membrane, grit removal equipment, coarse screens, fine screens, centrifuges, and ultraviolet disinfection equipment. It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year (FY), instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. The actions in the M&C will appropriate funds in support of the Water's portion of the City of Fort Worth's Fiscal Years 2025-2029 Capital Improvement Program. FISCAL INFORMATION I CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified -All Funds project within the Water & Sewer Bond 2017A Fund and upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the Water & Sewer Bond 2017A Fund for the Mary's Creek Water Reclamation Facility project to support the above recommendation. Prior to an expenditure being incurred, the Water Department has the responsibility of verifying the availability of funds.
