HomeMy WebLinkAboutOrdinance 27787-06-2025Ordinance No. 27787-06-2025 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PARD DEDICATION FEES FUND, IN THE AMOUNT OF $488,000.00, FROM AVAILABLE PARK PLANNING FEES WITHIN THE PARK PLANNING DISTRICT 4.1-5 (CITY PROJECT NO. UN8092), 4.2-1 (CITY PROJECT NO. UN8095), 4.2-2 (CITY PROJECT NO. UN8096), 4.3-1 (CITY PROJECT NO. UN8100), 4.3-3 (CITY PROJECT NO. UN8101), 4.5-1 (CITY PROJECT NO. UN8109) AND 4.7-6 (CITY PROJECT NO. UN8125), FOR THE PURPOSE OF FUNDING THE MEADOWOOD PARK LAND ACQUISITION PROJECT (CITY PROJECT NO. 106286); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2024-2025 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the PARD Dedication Fees Fund in the amount of $488,000.00, from available Park Planning Fees within the Park Planning District 4.1-5 (City Project No. UN8092), 4.2-1 (City Project No. UN8095), 4.2-2 (City Project No. UN8096), 4.3-1 (City Project No. UN8100), 4.3-3 (City Project No. UN8101), 4.5-1 (City Project No. UN8109) and 4.7-6 (City Project No. UN8125), for the purpose of funding the Meadowood Park land acquisition project (City Project No. 106286). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the acquisition of a fee simple interest in approximately 2.282 acres of land, being Block 46, Lots 1-14 of the Sycamore Heights Addition, an addition to the City of Fort Worth, located at 2800 Meadowbrook Drive and 2801 Purrington Avenue, Fort Worth, Texas, in the amount of $480,000.00 and pay estimated buyer closing costs in an amount up to $8,000.00; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the PARD Dedication Fees Fund in the amount of $488,000.00 from available Park Planning Fees within the Park Planning District 4.1-5 (City Project No. UN8092), 4.2-1 (City Project No. UN8095), 4.2-2 (City Project No. UN8096), 4.3-1 (City Project No. UN8100), 4.3-3 (City Project No. UN8101), 4.5-1 (City Project No. UN8109) and 4.7-6 (City Project No. UN8125) for the purpose of funding the Meadowood Park land acquisition project (City Project No. 106286); 3. Authorize the City Manager or designee to accept the conveyance, execute the necessary contract of sale and purchase, and to execute and record the appropriate instruments; 4. Dedicate the property as parkland to be known as Meadowood Park; and 5. Amend the Fiscal Years 2025-2029 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to seek approval to acquire land located at 2800 Meadowbrook Drive and 2801 Purrington Avenue, for the Park & Recreation Department (PARD) in accordance with the Neighborhood and Community Park Dedication Policy and the Park, Recreation and Open Space Master Plan, which calls for the provision of adequate park and recreational areas in the form of Neighborhood -Based Parks and Community -Based Parks. On May 23, 1978, (M&C G-3820) and May 13, 1980, (M&C G-4538) the Fort Worth City Council authorized the City Manager to enter into various cooperative facility improvement agreements between the PARD and Fort Worth Independent School District (FWISD) in the joint acquisition, development, maintenance, and/or use of facilities and services. The City provides general maintenance of the Meadowood Park property in accordance with the lease, but without fee ownership of the land. FWISD (Seller) has agreed to sell the property for a total price of $480,000.00 based on an independent appraisal of the property. The City will pay estimated closing costs in an amount up to $8,000.00. Funding for this project was not included in the PARD FY2025-2029 Capital Improvement Program due to the unpredictability of parkland acquisitions. The action in this M&C will amend the FY2025-2029 Capital Improvement Program as approved in connection with Ordinance 27107-09-2024, Section 8 Capital Improvements. The property is currently leased from the FWISD. Funding is availabe in the Pard Dedication Fees Fund for the Park & Recreation Department for the purpose of funding the Acquisition - Meadowood Park. Funding for ongoing maintenance currently exists in the General Fund. This property is located in COUNCIL DISTRICT 11. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: Fort Worth ISD FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the PPD 4.1-5, PPD 4.2-1, PPD 4.2-2, PPD 4.3-1, PPD 4.3-3, PPD 4.5-1 and PPD 4.7-6 projects within the Pard Dedication Fees Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the Pard Dedication Fees Fund for the Acquisition - Meadowood Park project. Prior to any expenditure being incurred, the Park & Recreation Department has the responsibility to validate the availability of funds.
