WORTH, TX Contract Renewal — CSC 51346-R5 Page 2 of 2 City of Fort Worth, Texas Mayor and Council Communication DATE: 10/15/24 M&C FILE NUMBER: M&C 24-0916 LOG NAME: 35LASALLE CORRECTIONS JAIL INTAKE SERVICES AMENDMENT SUBJECT (ALL) Authorize Amendment to Increase Annual Expenditures Under City Secretary Contract No. 51346 with LaSalle Corrections VI, LLC for Jail Intake Services by $434,150.00 Annually for a Total Annual Contract Amount Up to $4,184,150.00 for the Police Department RECOMMENDATION: It is recommended that the City Council authorize an amendment to increase annual expenditures under City Secretary Contract No. 51346 with LaSalle Corrections VI, LLC for jail intake services by $434,150.00 annually for a total annual contract amount of $4,184,150.00 for the Police Department. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize a contract amendment to increase the annual expenditures by $434,150.00 under existing City Secretary Contract (CSC) 51346 with LaSalle Corrections VI, LLC (LaSalle) for jail intake services. On September 25, 2018, via M&C C-28877, City Council authorized execution of an agreement with LaSalle for jail intake services in the annual amount of $3,350,000.00, The City of Fort Worth (City) does not have sufficient trained staff to provide booking, transfer, and detention of persons arrested by the City. Under the agreement, LaSalle is responsible for receiving, detaining, and caring for all properly classified inmates in compliance with Texas Police Chiefs Association (TCPA) best practices, the Texas Commission on Jail Standards (TCJS), if applicable, and state and local law. On October 11, 2022, via M&C 22-0809, City Council authorized an increase to the jail intake services agreement City Secretary Contract 51346 in the annual amount of $400,000.00 to allow LaSalle to increase wages in order to improve staffing shortages and retention levels while providing essential jail intake services. August 14, 2024, the City Attorney's Office approved a Chapter 252 Exemption from bidding requirements for jail facility operation and . management services with LaSalle due to public health and safety concerns if services are not maintained through LaSalle. The current term of CSC 51346 expires September 30, 2024, with four remaining one-year options to renew through September 30, 2028. Since 2018, a total 35 LaSalle employees have provided the City's jail intake services, 24 hours a day, seven (7) days a week. The City's jail intake facility operated by LaSalle has experienced over capacity issues during the last six months and LaSalle has requested additional officers to assist with these conditions. Upon City Council approval of this M&C, a contract amendment will be executed for LaSalle to hire six (6) additional officers and increase wages to maintain staff retention levels in the amount of $434,150.00 annually. The new annual contract amount will be $4,184,150.00. Funding will be budgeted In Other Contractual Services account within the Crime Control and Prev Distr Fund for Fiscal Year 2025, DVIN-BE: The Police Department was approved for a Chapter 252 Exemption by the City Attorney's Office for LaSalle jail facility operation and management services for the Police Department, Therefore, the business equity goal is not applicable. ADMINISTRATIVE CHANGE ORDER: An administrative change order or increase may be made by the City Manager up to the amount allowed by relevant law and the Fort Worth City Code and does not require specific City Council approval as long as sufficient funds have been appropriated. AGREEMENT TERM: Upon City Council's approval, a contract amendment will be executed with LaSalle for six (6) additional officers and wage increases to maintain staff retention levels, increasing the annual amount of the contract by $434,150.00 for a new annual contract amount of $4,184,150,00. The effective date of the contract amendment shall be October 1, 2024 and expire September 2025, with options to renew. RENEWAL OPTIONS: The Agreement currently allows for four additional one-year renewal terms upon the mutual agreement of the parties. This action does not require specific City Council approval provided that the City Council has appropriated sufficient funds to satisfy the City's obligations during the renewal period. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation and adoption of the Fiscal Year 2025 Budget by the City Council, funds will be available in the Fiscal Year 2025 operating budget, as appropriated, in the Crime Control & Prev Distr Fund. Prior to an expenditure being incurred, the Police Department has the responsibility to validate the availability of funds.
