("ENGINEER"); and WHEREAS, CITY and ENGINEER entered into that certain Original Agreement in the amount of $90,000 (City Secretary No. 56700, administratively authorized Nov. 18, 2021) for Project Development Services for the Storm Drain Pipe Rehabilitation Program, City Project No.: 102527; and WHEREAS, the Agreement was amended in the amount of $400,000 (M&C 22- 0313); and WHEREAS, M&C 22-0313 authorized up to two renewals of the Agreement; and WHEREAS, the parties desire to renew the Agreement, as amended, for its first renewal. NOW, THEREFORE, the Parties hereby agree as follows: Article I The Original Agreement, as amended, is hereby renewed for another term as described therein. Article II The ENGINEER's compensation for this Renewal shall be $490,000.00, as specified in Amendment 1. Adding Funds in the Amount of $400,000.00 for a Revised Contract Totaling $490,000.00 for Project Development Services for the Storm Drain Pipe Rehabilitation Program and Authorize Up to Two Renewals RECOMMENDATION: It is recommended that the City Council authorize the Amendment No. 1 to an Engineering Agreement with Halff Associates, Inc., City Secretary Contract No. 56700, to add funds in the amount of $400,000.00, for a revised contract amount of $490,000.00 for project development services for the Storm Drain Rehabilitation program (City Project No. 102527) and authorize up to two renewals. DISCUSSION: The amendment recommended by this Mayor and Council Communication (M&C) will provide for continued engineering and project development services for the Storm Drain Pipe Rehabilitation program. The consultant will develop effective, affordable, and acceptable storm drain pipe rehabilitation projects to be implemented as a part of the Stormwater Capital Improvement Program. The purpose of these storm drain pipe rehabilitation projects is to restore the structural integrity of existing storm drain pipes. These projects help to protect life safety, existing roads, infrastructure, and adjacent properties from cave-ins due to the failure of storm drain pipes. The 2020 Stormwater Revenue Bond funds this project. The development of a Storm Drain Rehabilitation Program is a Level 1 Priority Key Initiative included in the 2018 Council adopted Stormwater Management Program Master Plan. Storm drain rehabilitation is one of the Stormwater Program's top priorities due to the life safety risk that can happen when deteriorating storm drain pipes fail. In May 2018, the Transportation and Public Works Department (TPW), Stormwater Management Division, published a Request for Qualifications (RFQ) for various engineering consulting services. Based on the results of the RFQ, Halff Associates, Inc. (Halff) was selected as the most qualified consultant for this project and was engaged via a $90,000.00 administrative contract to expedite the rehabilitation of the highest priority storm drain pipes. The revised contract amount after this amendment will be $490,000.00. The City, at its sole option, may renew this contract, as amended, under the same terms and conditions up to two times. Funding is budgeted in the TPW Dept Highway & Streets Department's Stormwater Capital Projects Fund for the purpose of funding the Storm Drain Rehab Program project, as appropriated. Compliance with the City's Business Equity Ordinance has been achieved by the following method: Halff Associates agrees to maintain its initial M/WBE commitment of 12% that it made on the original agreement and extend and maintain that same M/WBE commitment of 12% to this first amendment. Therefore Halff Associates remains in compliance with the City's M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company. This project is located in ALL COUNCIL DISTRICTS. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the Stormwater Capital Projects Fund for the Storm Drain Rehab Program project to support the approval of the above recommendation and execution of the amendment. Prior to any expenditure being incurred, the Transportation & Public Works Department has the responsibility to validate the availability of funds.
