AMENDMENT No . 1
TO CITY SECRETARY CONTRACT No. CSC 58714
WHEREAS, the City of Fort Worth (CITY) and James DeOtte Engineering,
Inc., (ENGINEER) made and entered into City Secretary Contract No. CSC
58714, (the CONTRACT) which was authorized by M&C 22-1008 on the 291--h day
of November, 2022 in the amount of $ 766,497.00; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
20SWM Cunningham Road HROM, CPN 104018; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $124,511.00. (See Attached Funding Breakdown Sheet,
Page -4-)
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $891,008.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

This amendment came about due to the City providing a new, updated FEMA model.
The new model is significantly different from the model used for project development
and original handoff to James DeOtte Engineering, Inc. (JDEI). Thus, impacting several
of the contract task items. Additionally, the USACE requires the proposed grading
minimal impact to the existing perennial stream and wetlands that exist upstream and
down of the project location. Due to additional services that are outside the scope of
the existing contracted agreements that have been requested by the City to be
performed as part of the referenced project, JDEI will perform the work outlined in the
following:
Additional services shall include:
Additional time on the agreement that extends the number of months.
Based on 9 months of the schedule already expended to return to a point
where we can confidently begin the 30% design.
2. Revision to the proposed bridge design shifts the spans west along the road profile to
create grading that has less impact on the USACE wetlands.
Based on the needed alternations to place a new westerly bridge span and
remove the current easterly bridge span to preserve the overall bridge length.
3. Additional efforts for coordination with the Water Department to accommodate their
utility relocations requests.
Based on the efforts and amount of progress achieved per the quantity of
Water Department comments and feedback.

4. Revision to the easement parcels due to the updated hydraulic modeling provided
by the City.
Assumes 7 parcels previously prepared and submitted will need to be modified
that would be impacted by the updated grading necessary to be Fort Worth
design compliant.
5. Additional field topography and tree survey needed due to the updated hydraulic
modeling provided by the City.
Assumes an additional area impacted by the updated grading necessary to
be Fort Worth design compliant.
6. Additional efforts for coordination with the Texas Department of Transportation to
obtain the requested temporary and permanent driveway permits with their new
staff.
Based on the efforts and amount of progress achieved per the quantity of
TxDOT comments and feedback and staffing changes that have occurred
since these efforts have begun. This can be reduced if the City has other
means to obtain the needed permits.
7. Additional efforts to revise the grading to match the updated hydraulic modeling
provided by the City and verify design compliance.
Based on the efforts and amount anticipated to update grading and
modifications to hydraulic model to be Fort Worth design compliant.
8. Additional permitting for environmental and archeological needed due to the
updated hydraulic modeling provided by the City.
Assumes an additional area impacted by the updated grading necessary to
be Fort Worth design compliant.
The specific tasks to be accomplished with this Amendment are outlined within the
attached Level of Effort spreadsheet.
JDEI anticipates the fees listed above for the various elements of the project to be a not
to exceed amount of $124,51 1.00. All costs, associated with the identified scope of work,
will be lump sum for the scope provided and will be billed as a percentage of completed
work as determined by JDEI.
This scope of work assumes any services not specifically listed as part of this contract will
be treated as an additional service. The owner will be notified before any additional
services are performed.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment No. 1 to an engineering services agreement with James DeOtte Engineering, Inc., (City Secretary
Contract No. 58714), in the Amount of $124,511.00 for the Design of the Cunningham Road Hazardous Road Overtopping Mitigation
Project (City Project No. 104018) for a revised total contract amount of $891,008.00;
2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Drainage Revenue Bonds Series 2023
Fund, by increasing estimated receipts and appropriations in the Cunningham Rd HROM project (City Project No. 104018) in the amount of
$783,078.00, and decreasing estimated receipts and appropriations in the SW Hazardous Rd Overtopping programmable project (City
Project No. P00120) by the same amount; and
3. Amend the Fiscal Years 2025- 2029 Capital Improvement Program.
DISCUSSION:
On November 29, 2022, Mayor and Council Communication (M&C) 22-1008 authorized an engineering agreement with James DeOtte
Engineering, Inc. (City Secretary Contract No. 58714) in the amount of $766,497.00 for the design of the Cunningham Road Hazardous Road
Overtopping Mitigation (HROM) project. This M&C will authorize execution of Amendment No. 1 to the agreement and increase the contract
amount by $124,511.00, for a revised contract amount of $891,008.00.
The original contract included the design and engineering services, easement acquisition, and project administration costs for the Cunningham
Road HROM project. Additional contract capacity is needed for changes to design and permitting resulting from the Federal Emergency
Management Agency (FEMA) and United States Army Corps of Engineers (USACE) updated requirements.
Additional funding of $546,503.00 for right-of-way acquisition and project management is also being added to the Cunningham Road HROM
project (City Project No. 104018) since funding was previously transferred from the project on April 30, 2023, via M&C 23-0321 to help fund the
faster paced Fort Worth Central City Grand Avenue construction project. Additionally, this M&C will appropriate $112,064.00 of additional project
management funding needed due to a longer design timeframe to accommodate changes due to FEMA map updates and USACE comments.

The action in the M&C will appropriate funds in support of the Cunningham Rd HROM project (City Project No. 104018), as follows:

The Fiscal Years (FY) 2025- 2029 Capital Improvement Plan included $923,497.00 in funding for this project. However, additional funding of
$783,078.00 is needed to cover extended design efforts, project management, and replenishing funds removed from the project to fund the Fort
Worth Central City Grand Avenue construction project. The action in this M&C will amend the FY2025- 2029 Capital Improvement Program.
Funding is budgeted in the SW Hazardous Rd Overtopping project (City Project No. P00120) within the Drainage Rev Bonds Series 2023 Fund
for the purpose of funding the Cunningham Road HROM project.
James DeOtte Engineering, Inc. agrees to maintain its initial M/WBE commitment of 11.00% that it made on the original agreement and extend
and maintain that same M/WBE commitment of 11.00% to this first amendment. Therefore, James DeOtte Engineering, Inc. remains in
compliance with the City's M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment
form executed by an authorized representative of its company.
This project is located in COUNCIL DISTRICT 8.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Stormwater Hazardous Rd Overtopping project within the Drainage Rev
Bonds Series 2023 Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be
available in the Drainage Rev Bonds Series 2023 Fund for the Cunningham Rd HROM project to support the approval of the above
recommendations and execution of the agreement. Prior to any expenditure being incurred, the Transportation & Public Works Department has the
responsibility to validate the availability of funds.
