TRANSPORTATION IMPACT FEE CREDIT AGREEMENT AMENDMENT
AMENDMENT NO. 1
TO CITY SECRETARY CONTRACT NO. 61325
WHEREAS, the City of Fort Worth ("City"), a Texas home rule municipal corporation,
and Retreat at Fossil Creek, LTD., a Texas limited partnership authorized to do business in Texas
("Owner"), made and entered into a Transportation Impact Fee Credit Agreement, City Secretary
Contract No. 61325 (the "Agreement") on 04/25/2024; and
WHEREAS, the Owner has dedicated 52,038 square feet of additional right-of-way for
Willow Springs Road with FP-22-175, recorded as Instrument D224135046, on 07/31/2024; and
WHEREAS, it has become necessary to execute this Amendment No. 1 to said Agreement
to incorporate additional credits created by the dedication of Willow Springs Road right-of-way
by supplementing Exhibit "D" with the Exhibit "D-l" and supplementing Exhibit "E" with the
Exhibit "E-1";
NOW, THEREFORE, for and in consideration of the mutual agreements, covenants, and
conditions contained herein, and other good and valuable consideration, the City and the Owner
hereby covenant and agree as follows:
1. Recitals. The recitals contained in this Agreement are true and correct as of the
effective date of this Amendment and form the basis upon which the Parties negotiated
and entered into this Amendment.
2. Exhibit "D" to the Agreement shall be supplemented by adding Exhibit "D-1", attached
hereto and incorporated herein by this reference.
3. Exhibit "E" to the Agreement shall be supplemented by adding Exhibit "E-1 ", attached
hereto and incorporated herein by this reference.
All other provisions of the Agreement which are not expressly modified herein shall remain in full
force and effect.
