HomeMy WebLinkAboutOrdinance 27602-04-2025Ordinance No. 27602-04-2025 AN ORDINANCE ADJUSTING APPROPRIATIONS IN THE 2014 BOND PROGRAM FUND, BY INCREASING APPROPRIATIONS IN THE HERITAGE PARK; BUS 287 TO WEATHERFORD PROJECT (CITY PROJECT NO. 104146) IN THE AMOUNT OF $775,000.00, AND DECREASING APPROPRIATIONS IN THE HERITAGE PARK PROJECT (CITY PROJECT NO. CO2471) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2024-2025, as enacted by Ordinance 27107-09- 2024, as amended, is hereby further amended to make the following adjustments to appropriations in the 2014 Bond Program Fund, by increasing appropriations in the Heritage Park; Bus 287 to Weatherford Project (City Project No. 104146) in the amount of $775,000.00, and decreasing appropriations in the Heritage Park project (City Project No. CO2471) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent j urisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. City of Fort Worth, Texas Mayor and Council Communication DATE: 04/22/25 M&C FILE NUMBER: M&C 25-0386 LOG NAME: 2020HERITAGE PARK; BUS 287 TO WEATHERFORD AFA LOCAL SUBJECT (CD 9) Authorize the City's Local Participation in an Advanced Funding Agreement with the Texas Department of Transportation in an Amount of $1,275,000.00 for the Heritage Park; Bus 287 to Weatherford Project; Authorize the Transfer of Prior Year Expenditures in the Amount of $229,261.66 for Local Participation Expenditures Related to the Advanced Funding Agreement; Adopt Appropriation Ordinances and Amend the Transportation & Public Works Department's Fiscal Years 2025-2029 Capital Improvement Program (2022 Bond Program) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance adjusting appropriations in the 2014 Bond Program Fund by increasing appropriations in the Heritage Park; Bus 287 to Weatherford project (City Project No. 104146) in the amount of $775,000.00, and decreasing appropriations in the Heritage Park project (City project No. CO2471) by the same amount, for the Advanced Funding Agreement City's Participation; 2. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund by increasing appropriations in the Heritage Paris; Bus 287 to Weatherford project (City Project No. 104146) in the amount of $500,000.00 and decreasing appropriations in the Heritage and Paddock Parks Programmable project (City project No. P130027) by the same amount, for the Advanced Funding Agreement City's Participation; 3. Authorize the transfer of prior year expenditures, within the 2014 Bond Program Fund, in the amount of $229,261.66 from the Heritage Paris project (City project No. CO2471) to the Heritage Paris; Bus 287 to Weatherford project (City Project No. 104146) for local participation expenditures related to the Advanced Funding Agreement; and 4. Amend the Transportation & Public Works Department's Fiscal Year 2025-2029 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize the City's local participation in the Advanced Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) (City Secretary Contract No. 58480; CSJ # 0014-01-026, M&C 22-0533) and the transfer of AFA related expenditures for the Heritage Park; Bus 287 to Weatherford project (City Project No. 104146). The AFA is in the amount of $10,127,631.00 and provides for a local match in the amount of $1,775,000 of which $1,000,000.00 has been provided by Tarrant County and City participation in the amount of $775,000.00. Other expenditures to be transferred include $229,261.66 from the Heritage Park project (City project No. CO2471) to the Heritage Park; Bus 287 to Weatherford project (City Project No. 104146). These expenditures are related to the Advanced Funding Agreement and include City staff charges and consultant design charges. The City and Tarrant County have entered into an Interlocal Agreement (ILA) (City Secretary Contract No. 62395, M&C 24-0813) for a total funding amount of $2,000,000.00 for the project. The Heritage Park; BUS 287 to Weatherford Street project includes elements for enhancing the safety of pedestrian and vehicular movements. Improved pedestrian safety will be in the form of "bulb -outs" at the four intersections surrounding the Tarrant County Courthouse and at the intersection of Throckmorton and Belknap Street. Vehicular movement improvements will include installation of new traffic signals and roadway/lane alignments, removal of the bus counterflow lane on West Belknap Street and adjusting the geometry of Commerce Street and Houston Street adjacent to Paddock Park. New concrete pavement will be constructed on Belknap Street between Commerce Street and Houston Street. This Heritage Park; BUS 287 to Weatherford Street project is integral to the future success of the overall project to revitalize and improve the adjacent Heritage Park, which includes Heritage Plaza, and Paddock Park. Heritage Park and Paddock Park are located on the northern edge of the Trinity River bluff along and overlooking the Trinity River. Improvements to the two parks and North Main Street are a key linkage opportunity to the river that will complete a vision 50 years in the making. Funding for the project includes local City funds, County funds, Federal funds, and State funds. The City bears the responsibility to pay for cost overruns. The action in this M&C will amend the FY2025-2029 Capital Improvement Program as approved in connection with Ordinance 27107-09-2024. Funding is budgeted in the 2014 Bond Program Fund and 2022 Bond Program Fund within the Park and Recreation Department, for the purpose of funding the Heritage Park; Bus 287 to Weatherford project within Transportation and Public Works Department. This project is included in the 2022 Bond Program. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to make any interim progress payments until debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). This project is located in COUNCIL DISTRICT 9. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Heritage Park project within the 2014 Bond Program Fund and Heritage and Paddock Parks project within the 2022 Bond Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the 2022 Bond Program Fund and 2014 Bond Program Fund for the Heritage Park; BUS 287 to Weat project.
