COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth(City) and Kimley Horn and Associates, Inc.
("Consultant') made and entered into City Secretary Contract No. 37307 (the Contract);
WHEREAS, the Contract involves professional services for the following project:
Transportation Impact Fee Engineering Review
WHEREAS, it has become necessary to execute Amendment No.I to said
Contract to include an increased scope of work and revised maximum fee.
NOW THEREFORE, City and Consultant, acting herein by and through their
duly authorized representatives, enter into the following agreement which amends the
Contract:
1.
Article I of the Contract is amended to include the revised scope of services
specified in a proposal letter dated October 4, 2010, a copy of which is attached hereto
and incorporated herein. The cost to City for the additional services to be performed by
Consultant total $24,900.
2.
Article II of the Contract is amended to provide for an increase in the maximum
fee to be paid to Consultant for all work and services performed under the Contract, as
amended, so that the total fee paid by the City for all work and services shall not exceed
the sum of$49,800.
3.
All other provisions of the Contract, which are not expressly amended herein,
shall remain in full force and effect.

Dear Julia:
On May 13, 2008,the City of Fort Worth adopted a Transportation Impact Fee
Policy which became effective on July 1, 2008. Kimley-Horn and Assosciates,
Inc. (KHA)entered into a Transportation Impact Fee Engineering Review
contract with the City on July 10, 2008. The existing contract purpose was to
assist the City with the initial implementation, administration, plat review, and
building permit review. The scope of services provided the City of Fort Worth
with hourly engineering review support on an as needed basis for up to a
reimbursable basis not to exceed $24,900.
Additional review support continues to be provided on an as needed basis. We
anticipated performing the following the following tasks for a particular concept
plan, preliminary plat, final plat, building permit, or other plan for development
upon written notice from the City of Fort Worth:
• Determine the applicability of the transportation impact fee to a development
based on the location(Service Area)and date of final plat approval;
• Determine the potential transportation impact fee that could be due from a
development;
• Review development plans for potential improvements that may require the
creation of a transportation impact fee credit or concept agreement;
• Review and provide comments on traffic impact studies prepared for a
development;
• Assist in the determination of the roughly proportionate calculation related to
a development's construction of or contributions towards the City of Fort
Worth's Master Thoroughfare Plan;
• Assist in the development and review of Concept and/or Credit Agreements
for Transportation Impact Fees:

• Assist in the review of Transportation Impact Fee appeals;
• Determine the applicability of transportation impact fee discounts to a
particular development; and/or
• Assist providing training for City of Fort Worth employees.
We recommend that the City increase the maximum fee not to exceed budget by
$24,900 to continue to provide this services on an as needed basis. This will
increase the overall increase the maximum fee not to exceed budget to$49,800.
