HomeMy WebLinkAboutResolution 6153-08-2025A Resolution NO. 6153-08-2025 AUTHORIZING EXECUTION OF ONE OR MORE PRINCIPAL FORGIVENESS AGREEMENTS WITH THE TEXAS WATER DEVELOPMENT BOARD IN A CUMULATIVE AMOUNT OF $4,000,000.00 TO FUND THE SOUTHEAST LANDFILL PFAS LEACHATE PROJECT WHEREAS, per- and polyfluoroalkyl substances (PFAS) are a class of man-made chemicals that do not naturally break down and have been linked to negative health and environmental outcomes; and WHEREAS, leachate from the City's Southeast Landfill flows into creeks and streams that are part of the area water supply utilized by Fort Worth Water and its customers; and WHEREAS, the Fort Worth Water Department is undertaking a project to remove PFAS from the leachate in order to enhance water quality (the Project), with the total cost of the Project estimated to be $4,000,000.00; and WHEREAS, under the auspices of its Clean Water State Revolving Fund — Emerging Contaminants program, the Texas Water Development Board has made a commitment to provide financial assistance to the City in the form of principal forgiveness in a cumulative amount of $4,000,000.00 to finance the Project upon execution of one or more principal forgiveness agreements (TWDB Commitment Numbers LF 1001907 and LF 1002136). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: SECTION 1. Approval of Agreements. One or more agreements setting out the terms and conditions of the financial assistance between the Texas Water Development Board and the City of Fort Worth Water Department are approved, and the City's Designated Representative is authorized to execute the agreements on behalf of the City. SECTION 2. Effective Date. This Resolution shall become effective immediately after its adoption. Adopted this 26th day of August 2025. ATTEST: y: V Jannette S.
