AFFIRMING THE CITY'S OBLIGATION TO COMPLY WITH CERTAIN
STATUES ENACTED DURING THE REGULAR SESSION OF THE 89th TEXAS
LEGISLATURE
WHEREAS, during the regular session of the 891h Texas Legislature a number of
bills were approved that impact municipalities in numerous ways, including, but not
limited to, the use and development of property and the application of municipal zoning
authority; and
WHEREAS, the new legislation included Senate Bill 15, which amended Chapter
211 of the Texas Local Government Code by establishing regulations and development
standards for certain residential lot sizes and requiring cities to allow for small lot
development; and
WHEREAS, the new legislation also included Senate Bill 840, which amended the
Texas Local Government Code by creating Chapter 218, which requires cities to permit
the construction of multifamily and mixed -use residential development in a zoning
classification that allows for office, commercial, retail, warehouse, or mixed -use
development; and
WHEREAS, the new legislation also included Senate Bill 2477, which amended the
Texas Local Government Code to require cities to permit the conversion of existing
structures to multifamily and mixed -use residential development in zoning classifications
that allow for office, retail, or warehouse use; and
WHEREAS, many of the legislative bills passed during the regular session of the
89th Texas Legislature become effective on or before September 1, 2025; and
WHEREAS, the Development Services Department acknowledges and has advised
the City Council that the new legislation will require necessary changes to the City's Code
of Ordinances and Zoning Ordinance to ensure compliance with state law and regulatory
consistency for all developments; and
WHEREAS, amendments to the Code of Ordinances and Zoning Ordinance will be
presented to City Council for consideration and adoption at a date after September 1, 2025;
and
WHEREAS, City Council recognizes the impact of the laws passed during the 891h
Texas Legislature and acknowledges that the City will comply with the Texas Laws and
statutes that are effective on or before September 1, 2025, as required by law.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS, THAT:
That the City Council of the City of Fort Worth hereby affirms its obligation to
comply with certain Texas laws and statutes enacted during the regular session of the 89"
Texas Legislature, which are scheduled to take effect on or before September 1, 2025.
