AN ORDINANCE VACATING AND EXTINGUISHING A 10 FOOT WIDE BY
109.31-FOOT LONG OPEN YARD EASEMENT, LOCATED ALONG THE
SOUTH LINE OF LOT 28R, AND BETWEEN LOTS 28R AND 29R, BLOCK
5-R, CHAPEL CREEK ADDITION TO THE CITY OF FORT WORTH,
TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT a 10-foot wide by 109.31-foot long alley, located along the south line of Lot
28R and between Lots 28R and 29R, Block 5-R, Chapel Creek Addition, City of Fort Worth,
Tarrant County, Texas, and containing approximately 1093.10 square feet, as recorded in
Plat Records of Tarrant County, Texas, Chapel Creek Blocks 1-R through 5-R, Volume
388-153, Page 75, and as more specifically described in Exhibit A attached hereto and
incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above described vacated open yard easement is
hereby released and shall revert to the adjacent owners as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance vacating a 10-foot wide by
109.31-foot long open yard easement, located along the south line of Lot 28R and between Lots 28R
and 29R, Block 5-R, Chapel Creek Addition, as recorded in Chapel Creek Blocks 1-R through 5-R,
Volume 388-153, Page 75 of the Plat Records of Tarrant County, Texas, and containing approximately
1,093.10 square feet of land.
DISCUSSION:
Mickkelson & Cross and Robert Dinsmore, owners of the above-described property, have requested
vacation of the referenced open yard easement for new residential construction. The open yard
easement was originally established to provide for zero lot line development. Removal of this easement
would allow the construction of a residential structure across the property line, if both lots were under the
same ownership. There are no known utilities in the said easement.
The Engineering Department, Real Property Services Division states that a fee of $1.00 will satisfy the
public interest. Reviewing City departments and public utility companies have raised no objections to
this request. A replat is not required.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that this action will have no material effect on City funds.
