AMENDMENT No . 4
TO CITY SECRETARY CONTRACT No. 61189
WHEREAS, the City of Fort Worth (CITY) and CDM Smith Inc., (ENGINEER)
made and entered into City Secretary Contract No. 61189, (the CONTRACT)
which was authorized by M&C 24-0172 on the 27th day of February, 2024, in
the amount of $3,695,990.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment No.1 in
the amount of $0.00 administratively authorized on July 16th, 2024,
Amendment No.2 in the amount of $11,149,078.00 authorized by M&C 24-0729
on August 27th, 2024, and Amendment No.3 in the amount of $0.00
administratively authorized on March 5th, 2025; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Eagle Mountain Water Treatment Plant Expansion, CPN 1051 76; and
WHEREAS, it has become necessary to execute Amendment No. 4 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $6,249,236.00
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $21,094,304.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Dear Mr. McDonald:
This letter is in reference to a contract between Consultant (CDM Smith Inc.) and the City of Fort Worth
(the City) dated February 27, 2024 referred to herein as the "Contract." CDM Smith is pleased to submit
our Amendment No. 2 for the City's Eagle Mountain Water Treatment Plant Phase IV Expansion —
Project No. 105176.
CDM Smith was requested to complete engineering services during construction and additional services
(to be authorized by the City if needed). We request an amendment to our current contract for
performing these additional services. The attached scope of work provides a more detailed explanation
for these additional services. Also attached is our fee proposal table developed for the additional scope
of work.
The requested fee for Amendment 4 is $ 6,249,236.00. This fee is broken down as follows:

The scope set forth herein defines the work to be performed by the ENGINEER in
completing the project. Both the CITY and ENGINEER have attempted to clearly define the
work to be performed and address the needs of the Project.
PROJECT DEFINITION AND BACKGROUND
The City of Fort Worth (City) is expanding Eagle Mountain Water Treatment Plant (EMWTP)
from its current production capacity of 107 million gallons per day (mgd) to 142 mgd to meet
the City's projected water demand increases. The initial EMWTP Phase IV Expansion
(Phase IV Expansion) is expected to provide an additional 35 mgd of potable water to the
City's distribution system.
The Phase IV Expansion project includes the planning, design, and construction of large -
diameter piping, basins, filters, and other key infrastructure to accommodate additional
equipment in the future that will facilitate increasing the capacity of the Phase IV Expansion
by an additional 15 mgd (i.e., ultimate capacity of 50 mgd). Area at the site is being reserved
for a future 50 mgd Phase V Expansion facility (identical to Phase IV Expansion) to increase
the EMWTP to an ultimate buildout capacity of 207 mgd. Similarly, an area at the site is
being reserved for potential future per- and polyfluoroalkyl substances (PFAS) removal
facilities should the plant require additional treatment.

TASK 7 - CONSTRUCTION PHASE SERVICES
7.1 Project Management
ENGINEER will perform project management duties throughout the Construction Services
Phase of the Project based on the construction duration stated above.
7.1.1 General Project Management
ENGINEER will perform the following duties monthly:
• Lead, manage and direct ENGINEER'S project team activities.
• Review project budget and schedule weekly and communicate internally among
team members regarding task budget status.
• Review project monthly and assess risk, budget, schedule, out of scope items, on -
time delivery metrics, submittal review and RFI status.
• Task and allocate team resources.
• Communications and Reporting: Prepare and submit invoices and progress
reports monthly in the format requested by the CITY.
• Complete Monthly M/WBE Report Form and Final Summary Payment Report Form
at the end of the project.

7.1.2 Meetings
Pre -Construction Meeting (1): ENGINEER will attend one pre -construction meeting
with the CITY, Construction Manager (CM), Contractor, and their Subcontractors.
ENGINEER's Project Manager, Project Coordinator, and one Engineer representing
each of the following design disciplines will be in attendance: civil, geotechnical,
structural, electrical, and process -mechanical. ENGINEER assumes pre -construction
meeting will be in -person at Eagle Mountain and 2 hours in duration exclusive of
travel time.
Monthiv Construction Meetings (48): ENGINEER will attend monthly in -person
construction progress meetings with the CITY, CM, Contractor and their
Subcontractors. ENGINEER's Project Manager and ENGINEER's Project
Coordinator and one process mechanical engineer will attend up to 48 monthly
progress meetings.
One representative each for civil, architectural, structural, geotechnical, process
mechanical, electrical and instrumentation disciplines will attend up to 12 monthly
progress meetings, with meeting attendance determined by the corresponding work
of the forthcoming month.
ENGINEER assumes monthly meetings will be in person at Eagle Mountain and 2
hours in duration exclusive of travel time.
ENGINEER will attend up to five I&C coordination meetings with SCADA
Programmer (PCSS). I&C coordination meetings will generally follow the monthly
progress meetings. ENGINEER's Project Manager and up to two persons from
instrumentation discipline will attend meetings. ENGINEER assumes meetings to be
in person at EMWTP and 1 hour in duration exclusive of travel time.
Weekiv Construction Meetings (208): Engineer will attend weekly construction
meetings virtually. ENGINEER's Project Manager and up to two persons from the
design team will attend the 1-hour long weekly meetings via conference call.
Task 7.1.2 Assumptions
• ENGINEER assumes CM will conduct meetings and prepare meeting agenda and
meeting summaries. CM or Contractor will prepare submittal and RFI log.
ENGINEER assumes PCSS will conduct I&C coordination meetings and prepare
meeting agenda and meeting summary.
• Meetings with TCEQ are included in Task 7.13.
Task 7.1.2 Work Products
• None.
7.1.3 Site Visits and Inspections
ENGINEER will make up to 24 site visits, excluding site visits specified in Tasks
3.1.2, to the project site to observe the progress and quality of various aspects of the
construction work for the Project. Site visits shall be up to 2 hours in duration

excluding travel time and will be conducted as requested by the City and/or
Construction Manager as needed.
Limits of Responsibility: The purpose of site visits will be to enable ENGINEER to
carry out the duties and responsibilities assigned and undertaken by ENGINEER
during the Construction Phase, and, in addition, by the exercise of ENGINEER's
efforts as an experienced and qualified design professional, to provide the CITY
with a greater degree of confidence that the completed work will conform to the
Contract Documents and that the Contractor and its Subcontractors have
implemented and maintained the integrity of the design concept of the completed
Project as a functioning whole as indicated in the Contract Documents.
ENGINEER will not, during such visits or as a result of such observations of the
contractor's work in progress, supervise, direct, or have control over the
Contractor or its Subcontractor's work, nor shall ENGINEER have authority over
or responsibility for the means, methods, techniques, sequences, or procedures
of construction selected or used by the Contractor, for security or safety on the
site, for safety precautions and programs incident to the Contractor's or its
Subcontractors work, nor for any failure of the Contractor or its Subcontractors to
comply with Laws and Regulations applicable to the Contractor furnishing and
performing the work.
Task 7.1.3 Work Products
• Field Summary Report will be supplied to the Construction Manager following a
scheduled site visit specific to this task.
7.1.4 COORDINATION WITH CONSTRUCTION MANAGER
ENGINEER assumes CM services will be provided by others under separate contract with
City. The CITY's CM will serve as the project facilitator, coordinating the flow of information
between ENGINEER, CITY, and the CONTRACTOR. ENGINEER shall coordinate with the
CM on the following items.
• ENGINEER shall make clarifications and interpretations of the Contract Documents
to the CM.
• ENGINEER shall coordinate with CM to review the CONTRACTOR's monthly
progress schedule updates.
7.2 Shop Drawing Submittal Review
ENGINEER will review shop drawings, related data submittals, product samples, and
O&M submittals. All shop drawing submittal review comments will be uploaded to
City's web -based project management system (e-Builder or similar). ENGINEER will
perform technical and functional review of up to 1500 shop drawings and other
related submittals, resubmittals, and O&M Manuals.
Task 7.2 Assumptions
• ENGINEER will receive submittal notifications from e-Builder and distribute to design
team for review. ENGINEER will upload submittal review comments to web based
electronic document control and submittal management system.

• CM or CONTRACTOR will manage web based electronic document control and
submittal management system and will distribute submittals to ENGINEER for
review.
Task 7.2 Work Products
• Submittal review response (.pdf format) submitted through e-Builder
7.3 Test Reports
CONSTRUCTION MANAGER will review construction material test reports submitted
by the CONTRACTOR. ENGINEER will only review nonconforming reports when
provided by the Construction Manager for coordination on how to address
deficiencies. ENGINEER assumes up to 25 test reports will be submitted for review.
Task 7.3 Assumptions
• CM or CONTRACTOR will manage web based electronic document control and
submittal management system and will distribute test reports to ENGINEER for
review.
7.4 Request for Information (RFIs)
ENGINEER will make clarifications and interpretations of the Contract Documents.
ENGINEER will respond to up to 350 RFIs. All RFI responses will be uploaded to e-
builder.
Task 7.4 Assumptions
• ENGINEER assumes CM or CONTRACTOR will manage web based electronic
document control and RFI management system and will distribute RFIs to
ENGINEER for review. ENGINEER will upload RFI responses to web based
electronic document control and submittal management system.

7.5 Field Order/Change Orders
ENGINEER will issue and/or review up to 50 Field Orders and/or Change Orders.
When clarifications or interpretations result in a change cost or schedule,
ENGINEER will review cost estimates and prepare documentation for change orders.
When clarifications or interpretations result in a no -cost change order, ENGINEER
will prepare documentation for field order changes.
Task 7.5 Assumptions
• ENGINEER assumes CM or CONTRACTOR will manage documents on e-Builder
and field order/change order management system. Providing services to review or
evaluate construction contractor(s) claim(s), supported by causes not within the
control of ENGINEER are an Additional Service.

• Investigations, analyses, studies or design for substitutions of equipment or materials,
corrections of defective or deficient work of the contractor or other deviations from the
construction contract documents requested by the contractor and approved by the
ENGINEER or CITY are an Additional Service.
Task 7.5 Work Products

7.6 Instrumentation Witness Factory Test and Functional Demonstration Testing
ENGINEER will provide instrumentation and control system coordination and witness
factory and functional demonstration testing during construction. Testing will include
the Witness Factory Tests, Functional Demonstration Tests, and I&C assistance
during construction. It is assumed that up to ten, 8-hour days of factory testing, and
one 8-hour day of functional testing will be provided, with one lead instrumentation
engineer in attendance.
Task 7.6 Assumptions
• ENGINEER will not travel outside of the state of Texas to attend training and that the
ten days are divided into three separate trips, each either 3- or 4-days duration.
Task 7.6 Work Products
ENGINEER will upload to e-Builder report after each FAT testing with results of the
test.
7.7 Start -Up and Operations
ENGINEER will review Contractor's commissioning, start-up, and testing plan and
report to CITY. ENGINEER will participate in up to ten coordination meetings
regarding startup and commissioning planning for this project
ENGINEER will provide up to 160 hours of on -site assistance during plant start-up
for Milestone 1 and an additional 160 hours for Milestone 2.
Task 7.7 Work Products
ENGINEER will supply an email report to the Construction Manager after each day
on -site regarding testing/start up coordination as it is anticipated that as much of half
of the hours above will be performed on -site.
7.8 Substantial and Final Completion Walkthrough
ENGINEER will participate in two substantial completion walkthroughs and one final
completion inspection with the CITY, CM, and Contractor and assist with preparation
of substantial completion punch lists.
Milestone 1 walkthrough will include five process mechanical engineers, two site
civil, two instrumentation and controls, one architect, one structural, and two
electrical engineers for up to two, 8-hour days.

Milestone 2 walkthrough will include two process mechanical engineers, one site
civil, one instrumentation and controls, one structural, and two electrical engineers
for one 8-hour day.
Final Completion walkthrough will include two ENGINEER representatives for up to 4
hours.
Task 7.8 Work Products
• Substantial completion punch list (.xlsx format). One per milestone
• Final completion documentation of findings.
7.9 Record Drawings
ENGINEER will prepare Record Drawings from information provided by the
Contractor depicting any changes made to the Final Drawings during construction.
The following information will be provided by the Contractor:
• As -Built Survey
• Red -Line Markups from Contractor in electronic (PDF) format
• Copies of Approved Change Orders and Field Orders, annotated and referenced
into the red -line markups
ENGINEER will modify the Final Drawings electronically and will place a stamp on
the plans indicating that they represent Record Drawings of the project as
constructed.
The following disclaimer will be included with the Record Drawing stamp:
• These Record Drawings were prepared using information provided by others and
represent the as constructed conditions to the extent that documented changes
were provided for recording. The ENGINEER assumes no liability for
undocumented changes and certifies only that the documented changes are
accurately depicted on these drawings.
ENGINEER will submit a set of Final Drawings, modified and stamped as Record
Drawings for record storage. The ENGINEER may keep copies of the information
provided by the CITY for their files, but all original, red -lined drawings will be returned
to the CITY.
Record Drawings will also be submitted in .pdf format.
Task 7.9 Work Products

7.10 Operations and Maintenance Manual
Engineer will develop and implement an information system to document plant operation
and maintenance activities specific to Phase IV. The proposed electronic operation and

maintenance information system (EOMIS) will be provided as a comprehensive PDF-based
Phase IV EOMIS that will be stored on a common City -owned server and accessible
remotely by staff and authorized personnel through the use of computers and tablets.
The core foundation of the EOMIS will be the facility O&M manual and related information
assets. The EOMIS will provide an organized structure aligned to the facility with easy to
navigate controls that give access to essential operation information for knowledge transfer,
training and troubleshooting process operation. The EOMIS is a living, revisable operation
and maintenance documentation solution and this scope includes tools and training to allow
City staff to maintain content into the future, thus keeping the EOMIS current at all times.
The following outlines task details and deliverables for developing an Electronic Operation
and Maintenance manual. Engineer will perform the following tasks and subtasks as part of
the scope of work.
7.10.1 EOMIS Meetings
Kick Off Workshop: Engineer will coordinate and facilitate a half -day workshop to present
and discuss details of the EOMIS. The project kick-off session will facilitate presentation and
discussion of scope, schedule, format, and style of the EOMIS. A draft O&M manual TOC
list will be reviewed to establish the framework of the O&M information content. A sample
O&M manual section will be selected to develop draft documents.
EOMIS Review Meetings: Engineer will engage in up to two (2) on -site and one virtual
workshop with the City. Workshops will include conducting in person interviews and data
collection with City staff to discuss various aspects of the current plant operation.
• EOMIS Pilot Chapter Review Meeting and Interview
• EOMIS Milestone 1 Draft Review Meeting (In -Person)
• EOMIS Milestone 2 Draft Review Meeting (Virtual)
Training: Two virtual training sessions of two hours in duration. Each training sessions is
described below:
• Training Session 1 - The training will be presented in a classroom setting using a
Power Point presentation followed by a hands-on session that includes the use of
navigation and information organization as it relates to the EOMIS. The session will
include familiarization, authoring and review procedures and tools.
• Refresher Training — One refresher training will be held near Milestone2 in a two-
hour workshop to allow plant staff to review and ask questions of their understanding
of the EOMIS manual.
Task 7.10.1 Work Products
• Workshop agenda, presentation, and meeting summary.
• Draft EOMIS Manual Table of Contents.
Task 7.10.2 EOMIS Development
EOMIS Development: ENGINEER will develop the EOMIS following the final TOC listing and
format approved by the City. Development of the EOMIS will be completed in phases:

• EOMIS Pilot — This will be the creation of a draft chapter for the City's review to
establish the baseline for the balance of the EOMIS content.
• Draft EOMIS — Milestone 1 Deliverable
• Final EOMIS — Delivered with Milestone 2
After approval of the EOMIS Draft Chapter, development of the overall EOMIS will be
completed in two phases, timed with the completion of the various construction projects as
described above. At the end of each phase, a Draft EOMIS will be submitted to the City for
review and a workshop will be held in person to review and collect comments towards
finalizing the EOMIS Chapters issued per phase. As part of the EOMIS development, the
following services will be conducted:
• Existina Data Collection: Collection of Record Drawings, Vendor -Supplied Electronic/
Operation and Maintenance Information, data from the existing Operation and
Maintenance Manual, vendor contact information, and applicable warranties.
• Photographs: Engineer will capture and process photographs for inclusion in the manual.
Photographs of select processes and process equipment will be annotated to identify
important features and integrated into relative locations of the documents.
• ODerational Fiaures: Engineer will develop graphics and figures for each process for
reference in the EOMIS based on process flow diagrams, hydraulic profiles, site plans
and other information. An image of the figures will be integrated into the process
narratives, and also linked as a scalable PDF document for printing at any size.
• Record Drawinas: Engineer will include final record drawings in a tabular listing as
Adobe PDF files into the EOMIS. The drawing list will be programmed to link to each
drawing -by -drawing title -labeled link.
• Vendor -supplied Equipment O&M Manuals: This task includes listing and linking O&M
manuals for electronic storage and reference in operation narratives. The EOMIS will
have a dashboard button to display a full list of the equipment O&M manuals where each
listing will be linked to a specific submittal stored in the EOMIS.
• Field Verification: During field verification, Engineer will be on site at Plant 2 to work with
operations and maintenance staff as needed to clarify and verify O&M information to
complete the draft portions of the report.
Task 7.10.2 Work Products
At each Milestone, the ENGINEER will provide a Draft Field -verified EOMIS on an
USB drive for the City's review.
The final EOMs will be delivered to the City on a USB drive. In addition to the final
electronic document, four (4) hard copy submissions will be made at the end of each
section. The hard copies will include information prepared by Engineer, the SOPs,
and related figures. The hard copies will not include the vendor O&M manuals,
warranties, record drawings, etc. Those documents will be linked with the PDF, but
not in the hard copy.
Task 7.11 Standard Operating Procedures.
In conjunction with the development of the electronic O&M Manual, Engineer will develop up
to 12 new Standard Operating Procedures (SOP) that will provide detailed procedures for
the Phase IV treatment plant and processes requiring consistent, safe task completion. A

preliminary list and format for the SOPs will be prepared in conjunction with the plant staff
through a virtual meeting.
These SOPs will be linked to the EOMIS to provide instant access to pertinent operational
and maintenance staff. Each SOP will contain plant specific operations guidelines
developed specifically for the WTP.
Preparation for the SOPs will include collection of information, authoring of text, and
discussion and review with plant staff. The SOPs will be enhanced with photographs,
illustrations and/or figures for simplification and clarification of essential details. In addition,
control panel photos and pertinent screen shots will be included. The SOPs will be "specific
task" oriented and typically consist of two (2) to five (5) pages per procedure.
Draft SOPs will be provided to CITY staff for review and comment. Following receipt of
comments, the SOPs will be finalized. A conference call will be held after City review of
each group of SOPs and will be followed by finalization of that group of SOPs.
Task 7.11 Work Products
• Draft and Final SOPs (.doc and .pdf format)
• A virtual workshop will be held to review the City's comments after submittal of the
Draft Documents. Final SOPs will be incorporated into the final EOMIS.
Task 7.12 Special Inspections for Piers
ENGINEER will provide the following services in conjunction with the construction of drilled
cast -in -place pier foundations (drilled shafts) during the construction phase of the
PROJECT.
Meet with the City, Construction Manager (CM), and representatives of the Contractor (and
Subcontractors) to discuss the schedule, coordination requirements, acceptance criteria,
and reporting procedures involved with the installation of the piers and the engineering
observation thereof.
Visit the site and observe drilling, record bearing stratum penetration, installation of casing,
preparation of bearing surface, and concrete placement of drilled pier foundations. Prepare
daily field visit reports including description of procedures, identification and dimensions of
shafts installed, and any special observations or non -conformances with the Contract
Documents. Site inspections for this work will be performed by a licensed Professional
Geotechnical Engineer or an Engineer -in -Training (EIT) under direct supervision of the
licensed Professional Geotechnical Engineer.
Observe and document the soil and rock exposed at the drilled pier location and identify the
material classification and pier penetration into the design bearing stratum for each pier.
Provide non-standard pier penetrations or other field engineering support for special
conditions that do not match the pre -determined subsurface conditions. Prepare a drilled

pier installation log for each drilled pier documenting the minimum requirements included in
the ENGINEER's drilled pier specification.
Provide field coordination with ENGINEER's structural design team (or others as required) to
resolve unanticipated construction challenges as it relates to the drilled pier installation on a
timely basis.
Task 7.12 Assumptions
Drilled pier installation is assumed to be performed on a standard 5-day workweek.
An average of eight (8) drilled piers will be installed per working shift (10-hours) with two drill
rigs and a fulltime inspector with each drill rig.
Based on this assumed production, drilled pier observation support is anticipated for up to
62 working days (assumed 10-hr days) during the pier installation period for up to two (2)
pier inspectors. (Based on actual pier production layout and execution observed, pier
inspection may be reduced to only one inspector if conditions warrant.) Additional support
hours in excess of the specified number and working days are considered as special
services and would require an amendment to the contract.
Task 7.12 Work Product
Review approved shop drawings and material certified test reports related to the piers and
submit comments to the CM. Test reports will be reviewed for compliance with the drilled
pier specifications.
Prepare records supplementing reports submitted by the Contractor documenting the As -
built dimensions of each pier, and the compliance of pier installation with requirements of
the project specifications, and issues requiring correction or design adjustment.
Provide a summary report for the drilled pier special inspection work performed including a
summary of the piers installed (location, dimensions, actual versus design bearing
penetration, etc.). Copies of all final drilled shaft installation logs to be attached to the report.
Task 7.13 TCEQ Startup Support and Disinfection (CT) Studies
This task includes ENGINEER's support with the following TCEQ required activities:
• Disinfection (CT) Studies
• Conventional Surface Water Treatment Plant (SWTP) Step 2 Documents
• Plate Settler Full -Scale Verification Reports
• Membrane System Full -Scale Verification Report
As required by TCEQ, CDM Smith will prepare separate Disinfection (CT) Study Reports for
Milestone 1 and Milestone 2, respectively. Draft reports will be submitted to the City for
review before finalizing the reports and submitting them to TCEQ for review and approval.

Each report will be submitted to TCEQ when construction is approximately 90 percent
substantially complete and approximately 150 days before the anticipated dates of potable
water delivery to the City's distribution system for each milestone.
After receiving the respective approval letters from TCEQ for the CT Study Reports,
ENGINEER will prepare and submit the Step 2 documentation for Conventional Surface
Water Treatment Plant (SWTP) using a checklist including the following eight items for each
of the two milestones: 1) finished water quality; 2) finished water blending report; 3)
corrosion control report; 4) operator certifications; 5) operator training records for chemical
handling and safety; 6) letter from operator certifying plant is ready for operation; 7)
certificate of substantial completion from owner or engineer; and 8) CT Study approval letter
from TCEQ.
ENGINEER will schedule virtual meetings with the City and TCEQ before submitting each
CT Study to familiarize TCEQ reviewers with the project, startup approaches, and
disinfection strategies. ENGINEER will also schedule review meetings with the City and
TCEQ after receiving review comments from TCEQ for Milestone 1 CT Study and Milestone
2 CT Study, respectively.
This approach will provide TCEQ the required 60-day review periods (for the CT Studies and
Step 2 Documents review) and allow ENGINEER and the City approximately 4 weeks to
address comments, mitigate potential deficiencies, collect and analyze water quality
samples, and compile data.
ENGINEER will assist the City in preparing the full-scale verification test reports to
document the performance of the inclined plate settlers as required by TCEQ. This may
require separate 30-day testing periods for Milestone 1 and Milestone 2 to evaluate
performance at the design maximum surface overflow rate of 2.2 gpm/sf or 0.30 gpm/sf
effective plate settler surface loading rate (corresponding to 9,259 gpm or 13.3 mgd to each
flocculation/sedimentation train). The City will be responsible for collecting all flow, turbidity,
and related data and providing it to ENGINEER in Microsoft Excel (.xlsx) format. ENGINEER
will assemble the data and prepare the reports for review by the City before finalizing the
reports. The City will submit the final reports to TCEQ for each milestone.
ENGINEER will assist the City in preparing the full-scale verification test reports to
document the performance of the membrane system (specifically the Toray HFUG-2020AN
Ultrafiltration Module) as required by TCEQ. Prior to beginning the test, ENGINEER will
submit the Direct Integrity Testing (DIT) parameters to TCEQ (as part of the Step 2
Documents). The 40-day membrane full-scale verification testing period will be conducted
within 6 months after Milestone 2 and will consist of:
■ Initial testing period of 30-days of data collection
■ Membrane clean -in -place (CIP) procedure after 30-days of operation
■ Final testing period of 10-days after the CIP was conducted
City will be responsible for collecting all flow, turbidity, and related data and providing it to
ENGINEER in Microsoft Excel (.xlsx) format. ENGINEER will assemble the data and
prepare the report for review by the City before finalizing the report. The City will submit the
final report to TCEQ for upon completion and within 6 months of the EMWTP Phase IV
beginning to produce and distribute potable water with the membranes in service (i.e.,
Milestone 2).

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment No. 4 to an Engineering Agreement with CDM Smith Inc. (City
Secretary Contract No. 61189) in the amount of $6,249,236.00 for the Engineering Support Services
during construction, for the Eagle Mountain Water Treatment Plant 35 Million Gallons per Day
Expansion and Pump Station 2 project (City Project No. 105176) for a revised contract amount of
$21,094,304.00; and
2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the
Water & Sewer Revenue Bonds Series 2024 Fund by increasing estimated receipts and
appropriations in the Eagle Mountain Water Treatment Plant 35 Million Gallons per Day Expansion
and Pump Station 2 project (City Project No. 105176) in the amount of $6,372,979.00 and
decreasing estimated receipts and appropriations in the W&S Commercial Paper project (City
Project No. UCMLPR) by the same amount, to effect a portion of Water's contribution to the Fiscal
Years 2025-2029 Capital Improvement Program.
DISCUSSION:
On February 27, 2024, Mayor and Council Communication (M&C 24-0172), the City Council authorized
an engineering agreement in the amount of $3,695,990.00 with CDM Smith Inc. (City Secretary Contract
No. 61189) for the preliminary design of the Eagle Mountain Water Treatment Plant 35 Million Gallons per
Day (MGD) Expansion.
The agreement was subsequently revised by Amendment No. 1 with a net total amount of $0.00
administratively authorized on July 16, 2024, that allowed for replacing the work task for unit process
evaluation with the work task for Environmental Permitting and Texas Water Development Board report
document, Amendment No. 2 in the amount of $11,149,078.00 authorized by Mayor and Council
Communication (M&C) 24-0729 on August 27, 2024, that authorized final design for the project, and
Amendment No. 3 with a net total amount of $0.00 administratively authorized on March 5, 2025, that
provided for project cost substitution at no additional cost.
Amendment No. 4 provides for engineering support services during construction of the Eagle Mountain
Water Treatment Plant 35 MGD Expansion to include site visits and inspections, monthly construction
meetings, shop drawing review, response to requests for information, instrumentation witness factory test
and functional demonstration testing, start-up and operations, record drawings, operations and
administrative maintenance manuals, developing standard operating procedures, special inspections for
piers, and disinfection studies.
CDM Smith Inc., proposes to provide the necessary services for a fee not to exceed $6,249,236.00. Staff
considers the proposed fee to be fair and reasonable for the scope of services proposed.
In addition to the contract amount, $123,743.00 is required for staff project management costs.
It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year (FY),
instead of within the annual budget ordinance, as projects commence, additional funding needs are
identified, and to comply with bond covenants. The actions in the M&C will appropriate funds in support of
the Water's portion of the City of Fort Worth's Fiscal Years 2025-2029 Capital Improvement Program.
