HomeMy WebLinkAboutContract 62263-A1Date Received: 8/12/2025 Permit No.: SWFMA-25-0057 2:28 p.m. 62263-A1 Time Received: City Secretary No.: FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 62263 STORMWATER FACILITY MAINTENANCE AGREEMENT This AMENDMENT TO CITY SECRETARY CONTRACT NO. 62263, STORMWATER FACILITY MAINTENANCE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County, Texas, acting herein by and through its duly authorized City Manager or duly designated Assistant City Manager, hereinafter referred to as the "City", and GRBK Edgewood LLC, a Texas limited liability company, acting herein by and through its duly authorized representative, Bobby Samuel, its Vice President, hereinafter referred to as "Landowner", and the Madero Residential Community, Inc., a Texas nonprofit corporation. RECITALS WHEREAS, the City of Fort Worth ("City") and Landowner, and Association, made and entered into City Secretary Contract No. 62263 (the "Agreement") to authorize the use of on -site stormwater management facilities (the "Facility") to be constructed and maintained on a portion of Landowner's property; and WHEREAS, the Agreement was recorded with the property records of the Denton County as Document No. 2024-122657, which is one and the same as City Secretary Contract 62263. WHEREAS, the Agreement contains exhibit(s) "A" and "B" that depicts the location and design specifications of the Facility; and WHEREAS, it advisable to execute this Amendment to the Agreement to revise exhibit(s) "A" and `B" in the Agreement to depict changes in location and design changes being added to the original agreement; and OFFICIAL RECORD Revised 03/01/2022 BN CITY SECRETARY page 1 of6 FT. WORTH, TX NOW THEREFORE, City, Landowner, and Association, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. Exhibit A is hereby replaced with Exhibit A-1 attached hereto and incorporated herein to the Agreement, consisting of a revised location description of the Facility. 2. Exhibit B is hereby replaced with Exhibit 13-1 attached hereto and incorporated herein to the Agreement, consisting of revised design specifications of the Facility. 3. This Amendment shall be filed with the City Secretary as an amendment to the Agreement and also recorded among the land records of Denton County, Texas, and shall constitute a covenant running with the land, and shall be binding on the Landowner, its administrators, executors, assigns, heirs and any other successors in interests, including any property owners association. 4. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect. EXECUTED on this loth day of August . 2025 . NTS SHEET 160 OF 165 SHEETS Exhibit "C" CITY OF FORT WORTH STORMWATER FACILITY OPERATION AND MAINTENANCE PLAN FOR SWALES AND DITCHES The only responsibility the City of Fort Worth has in the operation and maintenance of this Facility is inspection. General Maintenance Procedures The structural and functional integrity of the facility or facilities described in "Exhibit A" shall be maintained at all times by removing and preventing drainage interference, obstructions, blockages, or other adverse effects into or throughout of the entire facility. Periodic silt removal shall occur when standing water conditions occur or the swale or ditch volume is reduced by more than 10%. Silt shall be removed and the swale or ditch returned to original lines and grades shown on the approved engineering plans. In addition, corrective measures are required any time the facility does not drain completely within 72 hours of cessation of inflow. **NO STANDING WATER IS ALLOWED in a facility designed to convey stormwater during, storm inflow, but to be maintained for dry purposes only. Accumulated litter, sediment, and debris shall be removed and not exceed 6 months of accumulation or as necessary to maintain proper operation of the facility or facilities. Disposal shall be in accordance with federal, state and local regulations. The facility or facilities as described in "Exhibit A" shall be mowed monthly at the minimum, between the months of April and October or anytime vegetation exceeds 12-inches in height. To prevent debris from entering and clogging the downstream outfall structure a wire mesh screen or similar screening device shall be installed over or around the structure until final acceptance. Preventive Maintenance and Inspection • Visual inspections of all components will be conducted every 6 months. • A log shall be kept of all maintenance actions, and inspections. The log should document the condition of the facility or facilities primary components, mowing, silt, litter and debris removal dates. • Written maintenance and repair records shall be maintained by the party or parties signing the attached Agreement and shall be provided to the City upon request.
