HomeMy WebLinkAboutResolution Crime Control and Prevention District (CCPD) CCPD-2014-00A RESOLUTION, ORDER, PROCLAMATION AND NOTICE CALLING FOR AN ELECTION TO BE HELD ON SATURDAY, MAY 10, 2014, ON THE CONTINUATION OF THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT FOR FIVE (5) YEARS AND THE CONTINUATION OF THE DISTRICT'S ONE-HALF CENT SALES TAX FOR FIVE YEARS WHEREAS, on February 5, 1995, the voters of the City of Fort Worth approved the creation of the Fort Worth Crime Control and Prevention District for a period of five years, together with a one-half cent sales tax to support the District's operations; and WHEREAS, on May 6, 2000, February 5, 2005, and November 3, 2009, the voters of the City of Fort Worth approved the continuation of the Fort Worth Crime Control and Prevention District for an additional period of five years, together with the continuation of a one-half cent sales tax to support the District's operations; and WHEREAS, pursuant to Section 363.301 of the Texas Local Government Code, the Fort Worth Crime Control and Prevention District will dissolve on September 30, 2015, unless the District holds a continuation referendum and a majority of the votes cast in the referendum are in favor of the District's continuation; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE FORT WORTH CRIME CONTROL AND PREVENTION DISTRICT THAT: SECTION 1. ELECTION ORDERED In compliance with the Charter of the City of Fort Worth and in accordance with the Constitution and laws of the State of Texas, the Board of Directors ("Board") of the Crime Control and Prevention District hereby orders that an election be held on Saturday, May 10, 2014, as authorized by Section 41.001 of the Texas Election Code at which all qualified voters may vote for the purpose of determining whether the Fort Worth Crime Control and Prevention District and its one-half cent sales tax shall be continued for an additional five years. The results of the election shall be determined as provided in the Texas Election Code and Chapter 363 of the Texas Local Government Code. SECTION 2. PROPOSITION and BALLOT The official ballot to be used in said election shall be prepared in accordance with Sections 52.072 and 52.073 of the Texas Election Code and Section 363.2515 of the Texas Local Government Code, and shall be printed to permit voting "FOR" or "AGAINST" the following proposition: ❑ FOR Whether the Fort Worth Crime Control and Prevention District should be continued for five (5) years and the Fort Worth Crime Control and ❑ AGAINST Prevention District sales tax of one-half cent should be continued for five (5) years SECTION 3. DISTRICT BOUNDARIES The boundaries of the Fort Worth Crime Control and Prevention District are and shall be the same as the corporate boundaries of the City of Fort Worth, as said corporate boundaries may be adjusted from time to time. The election shall be conducted within the prescribed boundaries of the Fort Worth Crime Control and Prevention District. The election precincts for said election shall be the regular election precincts of Tarrant and Denton counties, to the extent they are within the boundaries of the District. SECTION 4. ADMINISTRATION OF ELECTION The City of Fort Worth, which is the governing body that created the Fort Worth Crime Control and Prevention District, is hereby authorized to administer the election on behalf of the District, and shall do all things necessary to conduct the election on behalf of the District in accordance with the requirements of the Texas Election Code and Chapter 363 of the Texas Local Government Code. Accordingly, the District shall reimburse the City of Fort Worth for actual expenses incurred by the City in connection with the election, including, but not limited to, the costs of calling and conducting the election, and the costs of contracting with the Tarrant and Denton County Elections Administrators to administer the election. The City Secretary and the City Manager are hereby authorized CCPD Resolution May 10, 2014 Continuation Election Page 2 of 7 to contract with the Tarrant County and Denton County Elections Administrators for the purpose of having Tarrant and Denton Counties furnish all or any portion of the election services and equipment needed to conduct the election. SECTION 5. EARLY VOTING CLERKS (a) Steve Raborn, Tarrant County Elections Administrator, or his successor, shall serve as the early voting clerk for the Tarrant County portion of the election. (b) Frank Phillips, Denton County Elections Administrator, shall serve as the early voting cleric for the Denton County portion of the election. (c) Applications from Tarrant County residents for early voting ballots to be voted by mail should be forwarded as follows: Mailing address: Early Voting Clerk Tarrant County Elections P.O. SECTION 6. EARLY VOTING (a) Early Voting by personal appearance of Fort Worth residents shall be conducted beginning April 28, 2014, and continue through May 6, 2014. (b) The main Early Voting locations and times for Fort Worth residents are: (1) Voters residing in Tarrant County: Location: Tarrant County Elections Center 2700 Premier Street Fort Worth, Texas 76111 Times: April 28 — May 2 Monday — Friday 8:00 a.m. — 5:00 p.m. May 3 Saturday 7:00 a.m. — 7:00 p.m. May 4 Sunday 11:00 a.m. — 4:00 p.m. May 5 — 6 Monday — Tuesday 7:00 a.m. — 7:00 p.m. (2) Voters residing in Denton County: Location: Denton County Elections 701 Kimberly Drive Denton, Texas 76208 Times: April 28 — May 3 Monday — Saturday 8:00 a.m. — 5:00 p.m. May 5 — 6 Monday — Tuesday 7:00 a.m. — 7:00 p.m. (c) The locations and times at which early voting shall be conducted at branch early voting polling locations are contained in Exhibits A-1, Tarrant County residents, and A-2, Denton County residents, attached hereto. The City Secretary may change the places and/or times contained in Exhibits A-1 and A-2 without further Board action or approval after consulting with the Tarrant County Elections Administrator and/or the Denton County Elections Administrator and determining that a change in place and/or time is necessary. VOTING SYSTEM (a) An electronic voting system, as defined in Chapter 121 of the Texas Election Code, shall be used for voting at the regular polling places for said election and for counting the ballots and for tabulating the results. The conduct of the election and the use of the electronic voting system shall be in accordance with the Texas Election Code. (b) (1) The Office of the Tarrant County Elections Administrator, 2700 Premier Street, Fort Worth, Texas, is established as the Central Counting Station for the ballots cast in Tarrant County in said election. (2) The Office of the Denton County Elections Administrator, 701 Kimberly Drive, Denton, Texas, is established as the Central Counting Station for the ballots cast in Denton County in said election. (c) Each of the above -named Central Counting Stations shall appoint an individual, having knowledge and experience in the conduct of elections with the electronic voting system for which each Central Counting Station is established, as Manager of the respective Central Counting Station. The Manager shall be in charge of overall administration of the individual County's Central Counting Station and the general supervision of the personnel working at the Station. (d) Each of the Counties named in sub -section (b) above shall appoint an individual trained in the operation of the automatic tabulating equipment as Tabulation Supervisor. The Tabulation Supervisor shall be in charge of the operation of the automatic tabulating equipment in the respective county. (e) Each of the Counties named in sub -section (b) above shall appoint an individual as Assistant to the Tabulation Supervisor. Such Assistant shall assist the Tabulation Supervisor in the operation of the automatic tabulating equipment as directed by the Tabulation Supervisor. (f) Each of the Counties named in sub -section (b) above shall appoint an individual as Presiding Judge of the Central Counting Station. (g) The Tarrant and Denton County polling places shall be kept open on May 10, 2014, from 7:00 a.m. to 7:00 p.m., and due returns shall be made to the Board showing the number of votes cast "For" and "Against" the proposition set forth in Section 2 above. (h) The locations of the election day polling places for the election are contained in Exhibit B-1, Tarrant County Election Day Polling Sites, and Exhibit B-2, Denton County Election Day Polling Sites, attached hereto. The City Secretary may change the places and/or times contained in Exhibits B-1 and B-2 without further Board action or approval after consulting with the Tarrant County Elections Administrator and/or the Denton County Elections Administrator and determining that a change in place and/or time is necessary. SECTION 8. NOTICE AND PUBLICATION (a) A substantial copy of this Resolution shall serve as proper notice of said election, which notice shall be given by posting substantial copies of this Resolution in both English and Spanish on the bulletin board at the City Hall of the City used for the posting of notices of meetings of the Board not later than the twenty-first (21S) day prior to the date upon which said election is to be held; and substantial copies of this Resolution in both English and Spanish shall be published in a newspaper of general circulation in the City. (b) A copy of this Resolution shall be posted on the City's official website no later than the twenty-first (21 st) day before election day. CONTROLLING LAW That in all respects, said elections shall be conducted in accordance with the Texas Election Code, Texas Local Government Code, and the Charter of the City of Fort Worth, Texas. SECTION 10. OPEN MEETING COMPLIANCE That it is hereby officially found and determined that the meeting at which this resolution was adopted and said election was called was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551 of the Texas Government Code.
