HomeMy WebLinkAbout2013/10/29-Minutes-City Council-Executive Session CITY OF FORT WORTH, TEXAS SPECIAL CITY COUNCIL MEETING CLOSED EXECUTIVE SESSION OCTOBER 29, 2013 After proper notice given pursuant to the Texas Open Meetings Act, Mayor Price adjourned the Council meeting of the Fort Worth City Council at 9:28 a.m. on Tuesday, October 29, 2013, to convene into the Special City Council Meeting for the closed Executive Session in the Pre- Council Chamber of the Fort Worth Municipal Building. Present: Mayor Betsy Price Mayor Pro tem W.B. "Zim" Zimmerman, District 3 Council Member Salvador Espino, District 2 (arrived at 9:31) Council Member Daniel Scarth, District 4 Council Member Gyna Bivens, District 5 Council Member Jungus Jordan, District 6 Council Member Dennis Shingleton, District 7 Council Member Kelly Allen Gray, District 8 Council Member Joel Bums, District 9 Staff Present: Tom Higgins, City Manager Sarah Fullenwider, City Attorney Mary J. Kayser, City Secretary Fernando Costa, Assistant City Manager Susan Alanis, Assistant City Manager Charles Daniels, Assistant City Manager Gerald Pruitt, Deputy City Attorney Peter Vaky, Deputy City Attorney Jo Ann Rowls, Risk Management Frank Crumb, Water Department Director James Mauldin, Assistant Finance Director Harvey Frye, Sr. Assistant City Attorney Randle Harwood, Planning and Development Director Shannon Elder, Code Compliance With a quorum of the City Council Members present, the Fort Worth City Council convened into closed Executive Session at 9:29 a.m. on Tuesday, October 29, 2013, in the Pre-Council Chamber of the Fort Worth Municipal Building to discuss matters pertaining to the following: 1. Seek the advice of its attorneys concerning the following pending or contemplated litigation or other matters that are exempt from public disclosure under Article X, Section 9 of the Texas State Bar Rules and as authorized by Section 551.071 of the Texas Government Code: a. Roy Howard v. City of Fort Worth, No. 17-265127-13, 17" Judicial District Court, Tarrant County, Texas; CITY OF FORT WORTH, TEXAS SPECIAL CITY COUNCIL MEETING OCTOBER 29, 2013 PAGE 2 of 2 b. Legal issues concerning settlement of claim for property damage at 9716 Watercress Drive; c. City of Fort Worth v. Chesapeake Operating, Inc., and Total E & P (USA), Inc., Cause No. 48-268798-13, 480' District Court, Tarrant County, Texas; and d. Legal issues concerning any item listed on today's City Council meeting agendas; 2. Deliberate the purchase, sale, lease or value of real property in accordance with Section 551.072 of the Texas Government Code. Deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third party; and 3. Deliberate concerning economic development negotiations as authorized by Section 551.087 of the Texas Government Code; and 4. Deliberate the deployment, or specific occasions for implementation, of security personnel or devices, in accordance with Section 551,076 of the Texas Government Code. There was no formal action taken by the City Council on the items discussed during the Executive Session and with no further business to be conducted, Mayor Price adjourned the meeting at 9:36 a.m. on Tuesday, October 29, 2013.
