HomeMy WebLinkAboutOrdinance 15632ORDINANCE NO. j AN ORDINANCE AMENDING COMMERCIAL GARBAGE COLLECTION RATES IN ACCORDANCE WITH SECTION 12.5-842 OF THE CITY CODE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 12.5-842 of the City Code (the Code) provides that the City Council shall by ordinance set rates for solid waste collection services; WHEREAS, the Code provides that the Environmental Management Director shall charge customers rates pursuant to such schedules; WHEREAS, the City Council hereby approves a variable rate structure for commercial garbage collection services, with such rates to be charged per 96-gallon cart based on the frequency of collection; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: SECTION 1. The following commercial garbage collection fees are adopted as provided for in Section 12.5-842 of the Code of the City of Fort Worth, Texas (1986), as amended, based on 96-gallon carts: Frequency of Service I x per week 2 x per week 3 x per week 4 x per week 5 x per week 6 x per week Per Cart Rate (Plus Sales Tax) $ 23.00 S 34.00 S 49.00 $ 66.00 S 86.00 $110.00 This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986),, as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. This ordinance shall take effect on September 1, 2003. Approve the establishment of variable rate structure for commercial garbage service based on frequency of service effective September 1, 2003; and 2. Approve the following rates as provided in Section 12.5-842, of the City Code: Frequency of Service 1 x per week 2 x per week 3 x per week 4 x per week 5 x per week 6 x per week Per Cart Rate (Plus Sales Tax) 3. Adopt the attached ordinance pursuant to Section 12.5-842 of the City Code which provides that the City Council shall by ordinance set rates for solid waste collection services. Is] On November 5, 2002, the City Council approved the new solid waste plan that provided for variable rates depending on level of service provided. The residential variable rates were approved by the City Council on January 28, 2003 (M&C C-13867), and took effect July 1, 2003. That M&C indicated the commercial rate structure was to be re-evaluated and that a recommendation would be brought forward at a later date. The current commercial rates are for hand-loaded bags and three cubic yard containers. The rates in use were last set October 15,1991 (M&C G-9337). The three cubic yard container service was eliminated effective April 1, 2003, as a result of the new solid waste plan. The new solid waste plan provides for the use of 96 gallon carts. The proposed commercial rates are estimated to generate annual revenues for commercial collectil services of $630,192.00, dependent on cart distribution and use. The Finance Director certifies that the Water Department, as billing agent, is responsible for the collection of funds from solid waste customers. Revenues will be deposited in the Solid Waste Fund.
