IW1NUId lmll f/ ,..4.WIIiU ...✓OON/r RECOMMENDATION: r It is recommended that the City Council authorize the execution of a construction contract with McClendon Construction Company, Inc., in the amount of$368,556.50 for paving, ADA ramps and traffic signal improvements at two intersections, North Beach Street at Western Center Boulevard and i South Hulen Street at Granbury Road. DISCUSSION: P These projects were evaluated using the Intersection Improvements Criteria developed in 2004 to select locations where improvements are needed. rhe criteria are based on traffic congestion, vehicular delays, accident history and pedestrian access. These improvements include building an additional left turn lane with traffic signal modifications on North Beach Street at Western Center try Boulevard and an additional left turn lane with signal modification with audible pedestrian signals, ADA ramps and sidewalks on South Hulen Street at Granbury Road. Funding for this project is included in the 2008 Capital Improvement Program. The contract was advertised for bids in the Fort Worth Star-Telegram on August 22, 2013 and August 29, 2013. The following bids were received on September 19, 2013: BIDDER AMOUNT McClendon Construction Company, Inc. $368,556.5 The Fain Group, Inc. 11$422,968.87 M/WBE Office - McClendon Construction Company, Inc., is in compliance with the City's BDE Ordinance by committing to 10 percent MBE participation on this project. The City's MBE goal for this project is nine percent. Construction will begin January 2, 2014 with a duration of 180 calendar days estimating a completion date of July 2, 2014. These projects are located in COUNCIL DISTRICTS 4 and 6, Mapsco 36W and 89W. City and Contractor, in consideration of the mutual covenants hereinafter set forth, agree as i; follows: Article 1. WORK Contractor shall complete all Work as specified or indicated in the Contract Documents for the Project identified herein. Article 2. Article 3. CONTRACT TIME 3.1 Time is of the essence. All time limits for Milestones, if any, and Final Acceptance as stated in the Contract Documents are of the essence to this Contract. 3.2 Final Acceptance. The Work will be complete for Final Acceptance within 180 days after the date when the Contract Time commences to run as provided in Paragraph 2.03 of the General Conditions. 3.3 Liquidated damages Contractor recognizes that time is of the essence of this Agreement and that City will suffer financial loss if the Work is not completed within the times specified in Paragraph V 3,2 above, plus any extension thereof allowed in accordance with Article 12 of the General Conditions. The Contractor also recognizes die delays, expense and difficulties involved in proving in a legal proceeding the actual loss suffered by the City if the Work is not completed on time. Accordingly, instead of requiring any such proof, Contractor agrees that as liquidated damages for delay (but not as a penalty), Contractor shall pay City Two Hundred Forty Dollars ($2.40) for each day that expires after the time specified in Paragraph 3.2 for Final Acceptance until the City issues the Final Letter of ' Acceptance.
