AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $246,934.44,
SUBJECT TO RECEIPT OF AN EXECUTED CONTRACT, FOR THE PURPOSE
OF FUNDING AN AGREEMENT WITH THE TEXAS COMMISSION ON
ENVIRONMENTAL QUALITY FOR AIR POLLUTION CONTROL SERVICES;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2442-
2443 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Grants Fund in the amount of $246,934.44, subject to receipt of an executed
contract, for the purpose of funding an agreement with the Texas Commission on Environmental
Quality for Air Pollution Control Services.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to execute an agreement with the Texas Commission an Environmental
Quality {TGEQ) for air pollution control services with a maximum amount of $ 206,934 for the two
year term of the contract. The term of the agreement for the two year period September 1, 2003
through August 31, 2005; and
2. Authorize anon-interest bearing inter-fund loan from the Environmental Management Operating
Fund to the Grants Fund in the amount of $25,867 far interim financing far this grant pending
contract execution; and
3. Authorize the use of $50,961 per year from the General Fund as an in-kind match for this contract; and
4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund by $206,934 for fiscal years 2002-2003 through fiscal years 2004-2005, subject to
receipt of an executed contract; and
5. Apply indirect costs at the most recently approved rate of 20.59°l° for the Environmental
Management Department, not to exceed $21,304 per year.
DISCUSSION:
The TGEQ is the pass-through agency for all Environmental Protection Agency {EPA) Section 105
grant funds. EPA Section 105 grant funds have been received annually by the City Air Pollution Control
Program in cooperation with TCEQ to enforce federal and state Glean Air Act Provisions within the City.
This includes inspections of specific emission sources, daily manitaring of ozone and particulate Levels,
permit reviews and complaint investigations.
This grant requires a local in-kind mach of S50 96~ per year, The Cify must provide matching funds

FISCAL INFORMATIONlCERT1FiCATION:
The Finance Director certifies that upon approval of the above recommendations, adoption of the
attached appropriation ordinance, and execution of a contract, funds will be available in the current
operating budget, as appropriated, in the Grants Fund. Upon execution of the grant contract, the inter-
fund loan of $25,867 wi11 be returned to the Environmental Management Operating Fund.
